THIS RESOLUTION WAS NOT ACTED UPON BECAUSE Sponsored by: Murphy RESOLUTION 92-077 FAILED CITY OF SEWARD, ALASKA RESOLUTION NO. 92-078 A RESOLUTION OF THE CITY COUNCIL OF THE CITY I OF SEWARD, ALASKA, PROVIDING FOR THE SUBMISSION T~ THE QUALIFIED VOTERS OF THE CITY THE QUESTION qF APPROVAL OF A LEASE AGREEMENT WITH SEWARD S~P DRYDOCK, INC., AT A SPECIAL ELECTION TO BE HEL1J FOR THAT PURPOSE IN THE CITY OF SEWARD, ALASKA ON JUNE 23, 1992 WHEREAS, by Resolution No. 92-077, the City Council oi'the City of Seward has approved a lease agreement between the City and Seward Sl?{p Drydock, Inc.; and WHEREAS, the lease will not become effective until such time as the qualified voters have approved the lease agreement; and ' WHEREAS, the lease agreement provides for the disposition of property interests including the Shiplift Dock, the Syncrolift Shipl~ platform, the associated rail and transfer system, and the responsibilities for maintenance of other unle.ased but maintained publicly owned facilities at the Se,a'rd Marine Industrial Center; and WHEREAS, pursuant to Section 13.4 / the Seward City Charter, the City Council may sell, lease, or otherwise dispose of a ~nicipal utility or of property and interest in property used or useful in the operati_~~of a utility only after a proposition to do so is approved by three-fifths of the elect07 of the city voting on the proposition; and WHEREAS, pursuant to Sect.i~ 1.5(k) of the Seward City Charter, certain portions of the property subject to the lea~ include public utility property; NOW, THEREFORE, BriT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, ~I: / Section 1. An eJ,ection shall be held on June 23, 1992, in and for the city of Seward, for the purpo~ of submitting to the qualified voters of the city the question of approval of a lease a,treement with Seward Ship Drydock Inc. An affirmative vote of three-fifths of the q(1alified electors voting at the special election shall be required for approval of the l~se agreement. SectiOly2. The proposition shall be substantially in the following form': . . . CITY OF SEWARD, ALASKA RESOLUTION NO. 92-078 PROPOSITION NO. LEASE AGREEMENT WITH SEWARD SHIP DRYDOCK, INC. Do you approve the lease agreement between the City of Seward and Seward Ship Drydock, Inc., for the lease of approximately 20 acres of real property located within the Seward Marine Industrial Center including the syncrolift platform, the adjacent dock and associated rails and transfer system, as approved by the City Council in Resolution No. 92-077? Section 3. The foregoing proposition shall be printed on a ballot which may set forth other propositions. The proposition set forth in Section 2 shall be printed in full, and the following words shall be added as appropriate and next to a space provided for marking the ballots: PROPOSITION NO. YES NO Section 4. A person may vote at this election who (a) is qualified to vote in state elections under AS 15.05.010, (b) has been a resident of the City for at least 30 days immediately preceding the election, (c) is registered to vote in state elections at a residence address within the City at least 30 days before the election, and (d) is not disqualified under Article V of the Alaska Constitution. The election shall be conducted in compliance with the procedures established in Title 4 of the Seward City Code. Section 5. Publication of this resolution shall be made by posting a copy hereof on the City Hall bulletin board for a period of four week prior to the date of the election. In addition, copies of the resolutioin shall be made available at the City Clerk's Office for at least thirty days preceding the date of the election. Section 6. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 18th day of May, 1992.
