Sponsored by: Schaefermeyer CITY OF SEWARD, ALASKA RESOLUTION NO. 92-095 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING THE SMALL BOAT HARBOR TARIFF NO.1 WHEREAS, the city has experienced increased demand for certain harbor services which cost money for the city to provide and yet generate no revenue for the city; and WHEREAS, it is the policy of the city of Seward to operate the Small Boat Harbor on a ''break even" basis whereby charges for services rendered are intended to meet costs of operation; and WHEREAS, it is in the public interest that revenues to the Small Boat Harbor be generated by those members of the public that benefit from those services; and WHEREAS, the city of Seward has filed with the Federal Maritime Commission its Rates, Charges, Rules and Regulations for operation of the Small Boat Harbor; and WHEREAS, it is in the public interest, after notice and public hearing, to adjust the tariff; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. Amendment No.2 to the Small Boat Harbor Tariff No. I, as attached hereto, is hereby adopted. Section 2. This Amended Tariff shall take effect July 1, 1992, and after filing with the Federal Maritime Commission. (1) The vessel owner/operator has completed a Vessel Berthing Form in the form attached to this tariff. (2) The vessel owner/operator has paid the annual fee based on the following rates determined by the length of the vessel, or, in the case of a permanently assigned berth, the length of the slip, whichever is greater: Vessel or float to 30' 31' - 40' 41' - up $25. 56/foot/year $23. 27/foot/year $22.67/foot/year ISSUED: 06/23/92 EFFECTNE: 07/01/92 . . . CITY OF SEWARD SMALL BOAT HARBOR TARIFF NO.1 ORIGINAL PAGE 47 Subsection SEARCH AND RESCUE FEES 255 In addition to other tariff provisions, when the City utilizes City equipment and personnel to provide search and rescue assistance to vessels outside of the Small Boat Harbor such as towing, rescue the harbormaster will charge users of those services $125.00 per hour for the first hour or any part thereof, and any services beyond the first hour at 150% of City actual costs including city labor costs as determined in Section 245(b) of this tariff. CITY OF SEWARD SMALL BOAT HARBOR TARIFF NO.1 ORIGINAL PAGE 48 Subsection BOAT LAUNCH RAMP FEES 260 (a) USE OF PUBLIC LAUNCH RAMPS: The City owns and provides access to public launch ramps. Access to those ramps is generally on a first- come, first-served basis, but the harbormaster may deviate from that policy or refuse access to a ramp when, in his judgment, the public interest would be served and his consideration in that determination of the following factors: (1) The degree of existing or potential congestion in the harbor including upland storage areas and whether the proposed launch or retrieval will affect that congestion. (2) Whether the launch or retrieval poses a risk of loss of public or private property. (b) CHARGES FOR USE OF PUBLIC LAUNCH RAMPS: Vessels shall be charged $5.00 per launch from the public launch ramps, or Vessel owners or operators may obtain an annual launch permit for $50.00 entitling a specific vessel and owner to launches from January 1 through December 31 of each year. The annual fees shall not be prorated and the harbormaster will issue annual permits upon receipt of a completed application and payment therefore. ISSUED: 06/23/92 EFFECI1VE: 07/01/92
