CITY OF SEWARD, ALASKA
RESOLUTION NO. 92-105
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AUTHORIZING THE CONTINUATION OF A
LONG TERM LEASE OF LOT 2, BLOCK 1, MARINA SUBDIVISION,
TO JOAN L. CLEMENS AND MARK A CLEMENS
WHEREAS, Lot 2, Block 1, Marina Subdivision, has been under lease and in
commercial use since 1969 and is due to expire in seven years; and
WHEREAS, the lessee, in order to refinance the property to accomplish
renovations and consolidate certain liabilities, has requested an extension of the existing
lease; and
WHEREAS, the city concurs with the lessee's need for a longer term lease to
accomplish these goals; and
WHEREAS, the City Council has determined that the continued lease of the leased
land would be in the public interest; and
WHEREAS, because of the age of the existing lease document and the many
changes in law that have occurred in the past 20 years, the city opts for a new lease
rather than an extension of the existing lease;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized to execute a Notice of Lease
Termination for that lease dated September 29, 1977, recorded at Book 14, Page 975, by
and between the city of Seward and Joan 1. Clemens and the Estate of Dale B. Clemens,
successors in interest to Emory G. and Frieda O. Sample, Daniel A. and Ruth M. Smith,
and Pete Mineo, for Lot 2, Block 1, Marina Subdivision.
Section 2. The City Manager is further authorized to execute the long term lease
of Lot 2, Block 1, Marina Subdivision, between the city of Seward, Alaska, and Joan 1.
Clemens and Mark A. Clemens. A copy of the lease is attached and incorporated herein
by reference.
Section 3. This resolution shall take effect thirty (30) days following passage and
posting as required by law.
