Sponsored by: Schaefermeyer CITY OF SEWARD, ALASKA RESOLUTION NO. 92-133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, APPROVING A CONTRACT WITH HART-CROWSER, INC., FOR THE REMOVAL AND DISPOSAL OF UNDERGROUND STORAGE TANKS LOCATED IN THE CITY PUBLIC WORKS YARD WHEREAS, in accordance with City Code required bid procedures, the city of Seward advertised a request for proposals to provide professional services to perform site assessment necessary for the removal and disposal of underground storage tanks located in the city public works yard; and WHEREAS, three firms responded to the request for proposals; and WHEREAS, all three proposals were found to be responsive; and WHEREAS, only Hart-Crowser, Inc., was represented at the on-site pre-proposal meeting conducted by the city although all proposers were encouraged to attend; and WHEREAS, Hart-Crowser, Inc., appeared to have the best understanding of the site and local requirements and included with their cost estimate an estimate by B. C. Excavating from removal and disposal of the three fuel tanks; and WHEREAS, the proposal submitted by Hart-Crowser did not contain an estimate for storage, treabnent or disposal of the tanks' contents or any contaminated soil or water found at the site; and WHEREAS, the actual cost of professional services and tank removal will depend on the amount of contamination, if any, and could greatly exceed the estimate quoted in the proposals if extensive contamination is discovered; and WHEREAS, contractors removing underground storage tanks and/or contaminated soils must be certified by the Alaska Department of Environmental Conservation; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Manager is hereby authorized to execute a contract with Hart- Crowser, Inc., to provide professional services necessary to meet the requirements of the state of Alaska for removal of underground storage tanks for an amount not to exceed $14,820. . . CITY OF SEWARD, ALASKA RESOLUTION NO. 92-133 e Section 2. A project contingency account in the amount of $1,480 is hereby approved for a total project budget not to exceed $16,300. Section 3. It is in the public interest to waive the competitive bid process for the removal and disposal of the underground storage tanks because of the requirement that ADEC approve and certify the firm selected for removal and disposal of contaminants. Section 4. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 10th day of August, 1992.
