Sponsored by: Schaefermeyer CITY OF SEWARD, ALASKA RESOLUTION NO. 92-145 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING THE LEGAL FUND BUDGET WHEREAS, on August 18, 1992, the voters of the city of Seward defeated ballot propositions seeking the sale or the lease of the shiplift facility to James T. Pruitt; and WHEREAS, arbitration on Pruitt's existing lease with the city was put on hold pending the outcome of the special election noted above; and WHEREAS, in order to move forward with the arbitration, it is necessary to budget sufficient funds in the legal budget to cover projected costs of said arbitration; and WHEREAS, the arbitration will deal with both lease issues and shiplift tariff issues and will, therefore, be funded from both the Harbor Fund and the General Fund; and WHEREAS, the Fiscal Year 1993 legal budget includes $35,000 for General Fund arbitration costs; and WHEREAS, there are no funds currently budgeted within the Harbor Fund for arbitration expenses; and WHEREAS, the projected cost of the arbitration is $70,000; and WHEREAS, although this resolution was not included in the agenda published in the Seward Phoenix Log. the City Council finds that it is in the public interest to add this resolution to the August 24, 1992, agenda in order not to further delay arbitration; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The sum of $35,000.00 is hereby appropriated from the Harbor Fund Fund Balance Account No. 401-3070 to the Harbor Syncrolift Legal Line Item Account No. 401-4300-5170. Section 2. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 24th day of August, 1992. . .
