CITY OF SEWARD, ALASKA
RESOLUTION NO. 92-176
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROVING AN AGREEMENT WITH THE
ALASKA DEPARTMENT OF ENVIRONMENTAL CONSERVATION FOR
ALASKA CLEAN WATER FUNDS TOTALLING $40,000 FOR THE
DAIRY HILL PLAN AND DESIGN PROJECT AND APPROPRIATING FUNDS
WHEREAS, on June 23, 1992, the voters of the city of Seward approved the
issuance of debt for the purpose of planning, designing and constructing a sewage
collection system in the Dairy Hill area; and
WHEREAS, the Alaska Department of Environmental Conservation has approved
$40,000 of Alaska Clean Water Loan funds in the amount of $40,000 for this project; and
WHEREAS, interest on this loan has been set at 4.6%; and
WHEREAS, the proceeds from this loan will be used to determine the cost of
constructing a sewage collection system for Dairy Hill; and
WHEREAS, if the sewage collection system is constructed, this loan, along with
other costs of designing and constructing the system, will be paid in whole or in part by
those benefitting from the improvements through the creation of a sewer assessment
district; and
WHEREAS, if the city determines that it is in the public interest to proceed with
the construction of the project, additional loan monies are available from the Alaska
Clean Water Loan Fund to meet construction costs; and
WHEREAS, if the city determines that it is not in the public interest to proceed
with the construction of the project, the Water Sewer Fund will absorb the cost of
repaying the $40,000 loan;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized to execute a loan agreement
between the city and the Alaska Department of Environmental Conservation in an
amount not to exceed $40,000 for the purpose of designing a sewage collection system
for Dairy Hill.

Section 2. A capital project fund designated the Dairy Hill Sewer Capital Project
Fund No. 212 is hereby established and the amount of $40/000 is hereby appropriated
from the Water/Sewer Fund Loan Proceeds Account No. 701-3070 to the Dairy Hill Sewer
Capital Project Fund Account No. 212-2120-XXXX.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
26th day of October, 1992.
