CITY OF SEWARD, ALASKA
RESOLUTION NO. 92-180
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROVING A TRANSFER OF
RESPONSIBILITIES AGREEMENT BETWEEN THE CITY AND
THE ALASKA DOT!PF FOR DESIGN AND CONSTRUCTION OF
AN ELEVATOR IN CITY HALL
WHEREAS, a complaint was made against the State of Alaska Court System
because the courtroom on the second floor of city hall is not accessible to the disabled;
and
WHEREAS, following an agreement between the State of Alaska Human Rights
Commission and the Alaska Court System, the state has agreed to provide $215,000 to the
city of Seward to construct a new elevator; and
WHEREAS, a budget estimate prepared by Kumin and Associates, architects,
determined that the cost of the new elevator should not exceed $215,000; and
WHEREAS, the location of the new elevator requires that the underground storage
fuel tank serving city hall be relocated; and the city agrees to pay the cost, which may
exceed the $215,000 provided by the state for the project, associated with removal of the
tank and installation of a new tank; and
WHEREAS, nothing in the TORA is intended to prevent the city from pro-rating
the cost of maintenance and operation of the elevator between the city and the state in
accordance with the Space Agreement included in Chapter 107 of the 1966 Laws of
Alaska;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized to sign a Transfer of
Responsibilities Agreement with the Alaska Department of Transportation and Public
Facilities to accept $215,000 for design and construction of a new elevator in city hall.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
16th day of November, 1992.
