Sponsored by: Schaefenneyer CITY OF SEWARD, ALASKA RESOLUTION NO. 92-184 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD ALASKA, APPROVING AN AGREEMENT WITH THE UNITED STATES OF AMERICA TO CONDUCT A NAVIGATIONAL FEASIBILITY STUDY FOR BOAT HARBOR IMPROVEMENTS WHEREAS, the Congress has authorized the Corps of Engineers to conduct a study of a pennanent solution to navigation problems at Seward, Alaska, pursuant to authority provided by Section 107 of the Rivers and Harbors Act of 1960, as amendedj and WHEREAS, the Corps of Engineers conducted the Reconnaissance Study and detennined that further study in the nature of a Feasibility Study is requiredj and WHEREAS, the findings of the Reconnaissance Report were that the eastward expansion of the existing small boat harbor appears to satisfy most of the current demand while maintaining the present concentration of harbor activities near established harbor related businesses, and the cost of the expansion is estimated to be $13,739,000 and would achieve a benefit/cost ratio in excess 1.0j and WHEREAS, the cost of the feasibility study is estimated to be $407,500 and 50% of that amount ($203,750) must be provided by matching local funds or in-kind donationsj and WHEREAS, the Alaska Department of Transportation and Public Facilities (DOT/PF) has been requested to provide such funds to the city as sponsor of the project under a Transfer of Responsibilities Agreementj and WHEREAS~ the total construction cost of the project is estimated to be $12,000,000 and the total contribution by the Federal Government cannot exceed $4,000,000; and WHEREAS, the federal contribution to the cost of construction will be $3,570,000 after funding the studies; and WHEREAS, the local share of the cost of construction is estimated to be $8,430,000 in addition to the cost of harbor inner works which must be funded from local or state funds; and WHEREAS, the DOT/PF intends that the local city should own, operate and maintain the harbor facilitiesj . . . CITY OF SEWARD, ALASKA RESOLUTION NO. 92-184 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Manager is hereby authorized to sign an agreement between the United States of America and the City of Seward, Alaska, for harbor improvements at Seward, Alaska, Navigational Feasibility Study, except that the authority is contingent upon the City receiving matching funds from the Alaska DOTIPF. Section 2. . The City agrees to accept ownership and the responsibility for operation and maintenance of the new harbor facilities, not including existing harbor facilities that are in need of maintenance, repair and upgrade to current codes and regulations. Section 3. The City Manager shall prepare for inclusion in the capital improvements plan a project to fund the City's share of the harbor construction which is estimated to be $8,430,000 and also a project to fund construction of the harbor inner works. Section 4. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 16th day of November, 1992.
