RESOLUTION NO. 92-193
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AWARDING A CONTRACf FOR WINTER
MAINTENANCE OF LOWELL POINT ROAD AND APPROPRIATING FUNDS
WHEREAS, the city of Seward Street Department has historically performed only
the minimum maintenance necessary to enable passage of one 4-wheel drive vehicle
along the sewer main easement from Lowell Creek to the Sewage Treatment Plant; and
WHEREAS, this sewer easement is commonly referred to as Lowell Point Road;
and
WHEREAS, although funds have not been included in the Street Department
budget for this purpose, the actual maintenance requirements have frequently required
time and funds budgeted for other street maintenance work to be diverted to Lowell
Point Road; and
WHEREAS, the residents of Lowell Point reside outside the corporate boundaries
of the city of Seward and pay no property taxes to contribute towards the cost of
maintenance of Lowell Point Road; and
WHEREAS, neither the state of Alaska nor the Kenai Peninsula Borough have
acknowledged any responsibility to maintain or contribute to the cost of maintaining
Lowell Point Road; and
WHEREAS, the city of Seward recognizes that Lowell Point Road is the only
means of road access for the residents of Lowell Point to travel between their homes and
Seward where they may be employed and where their children attend school; and
WHEREAS, if not properly maintained, Lowell Point Road may be extremely
dangerous to travel by foot or vehicle due to slick, icy surfaces or avalanches; and
WHEREAS, bids to maintain Lowell Point Road were requested in accordance
with the requirements of the Seward City Code; and
WHEREAS, the bid submitted by Afognak Logging was determined to be the
lowest cost bid, and Afognak was found to have the necessary equipment and experience
to perform the work;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:

RESOLUTION NO. 92-193
Section 1. The sum of $13/000.00 is hereby appropriated from the General Fund
Fund Balance Account No. 101-3070 to the Street Department Account No. 131-1314-5390.
Section 2. The City Manager is authorized to execute a contract with Afognak
Logging, Inc., to provide winter maintenance of Lowell Point Road in accordance with
the bid specifications for an amount not to exceed $14/000.00.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
14th day of December, 1992.
