DELETED FROM AGENDA 03/22/93 Sponsored by: Tones / I / CITY OF SEWARD, ALASKA RESOLUTION NO. 93-035 A RESOLUTION OF TIlE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, APPROVING AN INDEMNIFICATION AGREEMENT WITIlE. PAUL DIENER WHEREAS, for over nine years, E. Paul Diener has worked tirelessly on behalf of the citizens of Seward in the capacity of Engineering & Utilities Manager; and WHEREAS, during that time, he has exemplified the highest qualities of public service, extraordinary energy and efforts, impeccable honesty and integrity, and an abiding loyalty to Seward; and WHEREAS, Mr. Diener's hard work has res';3lted in significant capital development for Seward, including Spring Creek CorrectjO,:,-al Center, major electrical system improvements, completion of public facilities t the Seward Marine Industrial Center, reconstruction of numerous public facilities lowing the floods of 1986 and 1989, Small Boat Harbor improvements, street, sidewal and lighting improvements, and new water and sewer facilities; and WHEREAS, Mr. Diener's eff , experience and knowledge have contributed significant savings to Seward in lowing much of the engineering services to be performed in-house; and has expressed his desire to retire from City service; and WHEREAS, Mr. Di er's numerous involvements, duties and responsibilities over the years of service 0 ity projects has placed him in a position of authority and responsibility and sub equent exposure to litigation; NOW TIlE FORE, BE IT RESOLVED BY TIlE CITY COUNCIL OF TIlE CITY ASKA, that: 1. The City of Seward shall indemnify, defend and hold harmless E. Paul Diener fr any and all claims, suits, administrative proceedings or any other proceedi gs related in any way to any actions, decisions, or inaction during his tenure with City of Seward as Engineering & Utilities Manager or in any other capacity, inclu ng those that might allege reckless or intentional misconduct. Section 2. Diener shall be promptly notified of any pending or threatened claim against him personally, and shall have the opportunity to participate in the defense thereof, including the selection of counsel acceptable to Diener. . . . CITY OF SEWARD, ALASKA RESOLUTION NO. 93-035 Section 3. This resolution shall take effect immediately upon its adoption.
