CITY OF SEWARD, ALASKA
RESOLUTION NO. 93-036
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, CONSENTING TO THE SUBLEASE OF
A PORTION OF LOT 2, BLOCK I, MARINA SUBDIVISION,
TO SANDRA AND HERMAN NELSON AND JON PERRY
WHEREAS, Mark Clemens, lessee of Lot 2, Block 1, Marina Subdivision, desires
to sublease a portion of his leased property to Sandra and Herman Nelson for the
operation of a restaurant facility for three yearsj and
WHEREAS, Clemens also desires to lease a separate portion of the property to Jon
Perry to operate a fresh seafood outlet for one yearj and
WHEREAS, operation of these businesses will provide a good service to the public
and help promote Seward as a well rounded business communityj
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The request for sublease by Mark Clemens ("Lessee") of portions of Lot
2, Block 1, Marina Subdivision (the "Premises"), to Sandra and Herman Nelson and Jon
Perry ("Sublessees") is approved, subject to the following terms and conditions:
A. Lessee shall remain responsible for performance of all his obligations under
his lease of the Premises from the City.
B. Nothing in this Resolution shall be construed as a consent to any additional
subleasing of the Premises without the express written consent of the City.
C. Each Sublessee shall be obligated to perform all terms and conditions of the
lease between Lessee and the City with respect to the subleased portion of
the Premises, except for the payment of rent to the City, and such terms
and conditions shall be incorporated in each sublease by reference.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
22nd day of March, 1993.
