Sponsored by: Tones CITY OF SEWARD, ALASKA RESOLUTION NO. 93-068 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, APPROPRIATING FUNDS TO REIMBURSE THE ALASKA DIVISION OF LANDS TO ACCOMPLISH THE TRANSFER OF STATE TIDELANDS TO THE CITY OF SEWARD WHEREAS, in March, 1981, the city of Seward ("City") applied to the Alaska Department of Natural Resources ("DNR") for the lease of state tidelands associated with the Seward Marine Industrial Center ("SMIC") development at Fourth of July Creek; and WHEREAS, in December, 1983, City transmitted a completed survey plat for Alaska Tideland Survey ("A TS") 1222 to DNR; and WHEREAS, in July, 1986, City requested DNR to change the ATS 1222 lease request to a fee simple title conveyance pursuant to AS 38.05.320(b); and WHEREAS, City has adopted a tideland preference ordinance compatible with state regulations; and WHEREAS, City has completed a preliminary subdivision of lands in the Fourth of July Creek area to provide for state land and water access in return for the vacation of shoreline pedestrian easements that conflict with the industrial nature of SMIC; and WHEREAS, now that City has completed the necessary requirements for state conveyance of ATS 1222 tidelands to City, the state has no funding source available to accomplish the transfer except by city reimbursement of its direct costs; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The sum of $19,177 is hereby appropriated from the FY 1994 Harbor Fund Fund Balance Account No. 401-3070 to the Harbor Special Services Account No. 401-4110-5190 for the purpose of reimbursing the state of Alaska for direct costs associated with the transfer of tidelands designated as A TS 1222 and further identified by the state of Alaska as ADL 209499. Section 2. The City Manager is hereby authorized to issue a Purchase Order not to exceed the amount of $19,177 to reimburse the state of Alaska Division of Lands for staff work involved in the ownership transfer of SMIC tidelands ATS 1222 from the state to the city.
