RESOLUTION NO. 93-071
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROVING A CHANGE ORDER
TO THE CH2M HILL CONTRACT FOR LOWELL POINT SEWAGE
LAGOON PROJECT MANAGEMENT
WHEREAS, CH2M Hill is under contract to provide project management services
for repair of the Lowell Point Sewage Lagoon; and
WHEREAS, the cause of the failure of the lagoon has not been determined and
a determination is necessary in order for the City to decide if any party is liable for all
or part of the repair cost; and
WHEREAS, the agreement with the State authorizing disaster funds includes a
requirement to investigate the failure; and
WHEREAS, CH2M Hill has been tasked to investigate the failure of the lagoon
and to assist the city to recover damages, if possible, from a third party; and
WHEREAS, the investigation can now proceed since the bottom of the lagoon has
been exposed;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to approve a change order to the
CH2M Hill contract, for a cost not to exceed $23,700.00 for a total contract cost of
$254,658.00, to provide for investigation of the failure of the Lowell Point Sewage Lagoon.
Section 2. The City will be kept informed of the progress of the investigation and
the City is authorized to stop further work at any time.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
24th day of May, 1993.
