Sponsored by: Tones CITY OF SEWARD, ALASKA RESOLUTION NO. 93-096 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, APPROPRIATING FUNDS FROM RAW FISH TAX REVENUES FOR THE PAYMENT OF LITIGATION COSTS ASSOCIATED WITH THE CITY'S SUIT AGAINST EXXON WHEREAS, on April 12, 1993, the City Council approved Resolution No. 93-042, authorizing the execution of the Fisheries Business Tax Allocation and Disbursement Agreement; and WHEREAS, as a result of a settlement under this agreement, the city has received $37,737.00 in Raw Fish Tax Revenues from the State of Alaska; and WHEREAS, Matt Jamin, the attorney representing the city in its suit against Exxon, has requested that $32,577.50 of this amount be returned to him to cover costs of litigating and to partially offset the costs of expert reports prepared to justify the city's claims; and WHEREAS, the remaining $5,159.50 will partially offset the previous legal costs paid by the city for the Exxon litigation; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The sum of $32,577.50 is hereby appropriated from the General Fund Raw Fish Tax Revenue Account No. 101-0000-4350-0130 to the General Fund Legal Subject Matter, Exxon Litigation, Account No. 101-1115-5170-1004. Section 2. The City Manager is authorized to issue a check in the amount of $32,577.50 to Jamin, Ebell, Bolger & Gentry in payment of costs associated with the Exxon litigation. Section. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 28th day of June, 1993. . . .
