RESOLUTION NO. 93-108
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROVING AMENDMENT NO.3 TO
THE TORA FOR THE SPRING CREEK PRISON INDUSTRIES
PROJECT NO. 58281
WHEREAS, in August 1989, the city entered into a Transfer of Responsibilities
Agreement (TaRA) with the state of Alaska for management of the Prison Industries
Addition Project No. 58281; and
WHEREAS, the state has requested that the city approve Amendment No.3 to the
TaRA certifying that the project has been completed and all funds under the TaRA have
been received; and
WHEREAS, the administration has confirmed that the project is complete and all
funds have been received from the state of Alaska;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. Amendment No. 3 to the TaRA for the Prison Industries Addition
Project No. 58281, a copy of which is attached and incorporated herein by reference, is
hereby approved.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
13th day of September, 1993.

AMENDMENT NO. THREE
TO THE
TRANSFER OF RESPONSIBILITIES AGREEMENT

The Transfer of Responsibilities Agreement, effective the 17th day
of August, 1989, between the State of Alaska Department of
Transportation and Public Facilities and the City of Seward for
the purpose of constructing a prison industries addition and other
work noted in Appendix A is hereby amended as follows:
By execution of this Amendment, the Municipality hereby agrees
that it has been paid in full by the State in the amount of
Three Hundred Fifty Seven Thousand, Four Hundred dollars
($357,400.00) and that this figure represents the final
funding level for this project and Agreement.
The Municipality further agrees and certifies that the project
scope, as originally written or as may have been subsequently
amended by written mutual agreement of both parties, has been
completed in full by the terms of said Agreement and/or
Amendment.
The State hereby agrees that it accepts the project as
described in Appendix A to the Agreement, or as may have been
subsequently amended by mutual agreement of both parties.
In witness whereof, the parties hereto have executed this Amendment
No. One to the Agreement as of the day of , 1991.
