RESOLUTION 99-170
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROVING A TEMPORARY EXTENSION OF THE SHIPLIFT
MAINTENANCE AND OPERATING AGREEMENT BETWEEN THE CITY
OF SEWARD, ALASKA AND SEWARD SHIP'S DRYDOCK, INC.
WHEREAS, The City of Seward ("City") and Seward Ship's Drydock, Inc. entered into a
certain Maintenance and Operating Agreement dated April 25, 1995 (the "Maintenance and
Operating Agreement") and said agreement is to expire by its terms on December 31, 1999;
WHEREAS, The City and Seward Ship's Drydock, Inc. desire to extend the terms of the
Maintenance and Operating Agreement between the City and Seward Ship's Drydock, Inc. for 31
days; and
WHEREAS, this temporary extension will allow time to finalize negotiations for a possible
extension of the Maintenance and Operating Agreement for a term of approximately five years;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to enter into a temporary 31 day extension ofthe
Maintenance and Operating Agreement.
Section 2. The 31 day temporary extension will expire on January 31, 2000.
Section 3. During the period of the temporary extension, all terms and conditions of the
Maintenance and Operating Agreement shall continue as stated therein.
Section 4. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this 13 day
of December, 1999.
