RESOLUTION 99-171
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO TRADE IN SEWARD
COMMUNITY LIBRARY'S USED XEROX COPIER AND ENTER INTO A
SIXTY-MONTH LEASE AGREEMENT WITH XEROX AT A COST OF
$207.16 PER MONTH FOR A NEW COPIER.
WHEREAS, the library's current copier, a Xerox BookMark 35, is almost five years old and
has recently experienced some problems, resulting in copier downtime and staff/patron frustration
due to lack of service; and
WHEREAS, the City owns the machine and is paying a monthly maintenance fee as well
as parts and copy charges; and
WHEREAS, the copier is not ADA compliant and requires that patrons pay for each copy
at the desk utilizing staff time; and
WHEREAS, Xerox has prepared a lease agreement for a Xerox BookMark 21 CO copier
that is wheelchair accessible, has coin-operated features and provides full-service maintenance
including parts and labor for a monthly charge of $207.16; and
WHEREAS, in accordance with City Code S 6.10.130, exemption from the city's
competitive bid procedure is authorized based on the following: 1) the current copier has a higher
trade-in value with Xerox; 2) Xerox removes the current copier at no extra cost; and 3) the
maintenance level is excellent from Xerox due to their Kenai Peninsula presence and the large
number of Xerox copiers in Seward;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is approved to enter into a 60-month lease agreement with
Xerox at a cost of $207.16 per month, with funding from the Calendar Year 2000 General Fund
Library Budget Equipment Rental Account.
Section 2. It determines that it is in the public's interest to waive the normal bid process per
City Code S6.10.130 and authorize the City Manager to enter into a lease agreement with Xerox for
a copier at Seward Community Library.

Section 3. This resolution shall take effect immediately upon its adoption.
