CITY OF SEWARD, ALASKA
RESOLUTION NO. 93-157
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AUTHORIZING ACCEPTANCE OF A
SETTLEMENT OFFER AND INSURANCE RELEASE RELATIVE TO
WIND DAMAGE AT THE LOWELL POINT SEWAGE LAGOON
AND APPROPRIATING FUNDS
WHEREAS, the city of Seward has received an insurance settlement offer totalling
$62,500 for the wind damage that occurred on October 20, 1991, at the Lowell Point
Sewage Lagoon during the process of emptying the lagoon; and
WHEREAS, this wind damage was covered under the city's insurance pool with
the Alaska Municipal League Joint Insurance Association; and
WHEREAS, the city's deductible under the insurance pool is $5,000, leaving the
city with a total settlement of $57,500 if the offer is accepted; and
WHEREAS, it is the city's intent to use these funds to offset the costs of restoring
the lagoon; and
WHEREAS, the AMLJIA's excess property insurance carrier, Industrial Indemnity,
requires the city to sign a claim release before the funds can be sent to the city; and
WHEREAS, it is in the public interest to accept this insurance settlement;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized to accept the insurance
settlement offer of $62,500 for wind damage sustained at the Lowell Point Sewage
Lagoon on October 20, 1991, and to execute the appropriate settlement release form as
required by Industrial Indemnity.
Section 2. The sum of $57,500 is hereby accepted and appropriated to the Lowell
Point Sewage Lagoon Capital Project Fund.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
4th day of November, 1993.
