CITY OF SEWARD, ALASKA
RESOLUTION 99-175
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A
PROFESSIONAL SERVICES AGREEMENT WITH MACSW AIN ASSO-
CIA TES FOR LAND APPRAISAL SERVICES
WHEREAS, a request for proposals for land appraisal services was advertised in accordance
with the Seward City Code; and
WHEREAS, one firm, MacSwain Associates, submitted a proposal that was found to be
responsive; and
WHEREAS, a proposal evaluation committee reviewed the proposal independently without
regard to the bid price to determine overall qualifications, past performance, availability, and
understanding of the project; and
WHEREAS, MacSwain Associates was found to be responsive, responsible, and the cost
allowed for a majority of the proposed work to be completed; and
WHEREAS, through negotiation (as permitted by the RFP and Seward City Code 6.10.145
where available funding is insufficient) the City Manager negotiated an Agreement that is within
budget;
WHEREAS, the proposed Agreement will keep the City within budget, will provide the City
with appraisals on all of the areas identified as highest priority, and ensures that the project will be
completed on time; and
WHEREAS, the City believes this Agreement is equitable for both parties, is in the best
interest of the City, and does not affect the competitive nature of the proposal process;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to enter into the attached Professional Services
Agreement with MacSwain Associates for Land Appraisal Services for an amount not to exceed
$30,000.
Section 2. This resolution shall take effect immediately upon its adoption.
