Sponsored by: lanes CITY OF SEWARD, ALASKA RESOLUTION NO. 94-015 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE TRADE OF LOT 7, BLOCK 10, FEDERAL ADDITION, TO MICHAEL J. AND MARY JANE MEEHAN IN RETURN FOR DEDICATION OF THE EASTERN MOST TEN FEET OF LOT 5, BLOCK 4, OCEANVIEW SUBDIVISION ADDITION NO. I, AS AN ALLEY RIGHT OF WAY WHEREAS, in 1980, Michael J. and Mary Jane Meehan proposed the exchange of the eastern most ten feet of Lot 5, Block 4, Oceanview Subdivision Addition No.1, which was originally part of the alley right of way, in return for the remainder of Lot 7, Block 10, Federal Addition; and WHEREAS, city Resolution No. 80-24 authorized the city administration to negotiate the requested trade; and WHEREAS, Meehan took no action to complete a survey of the property and the file became inactive; and WHEREAS, in April, 1993, Meehan had the property surveyed and re-initiated the exchange process; and WHEREAS, at this time, it was determined by city staff that the city did not hold title to the requested Lot 7, Block 10, Federal Addition; and WHEREAS, the city has recently received title to the requested parcel; and WHEREAS, a portion of this lot was included in the creation of the Oceanview Subdivision and the remainder is a non-conforming lot as presently configured; and WHEREAS, the eastern ten feet of Lot 5, Block 4, Oceanview Subdivision, continues to be used as an alley; and WHEREAS, given the value of the land involved relative to the expense of appraising the property, it is in the public interest to waive the standard appraisal process; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: . . . CITY OF SEWARD, ALASKA RESOLUTION NO. 94-015 Section 1. The City Manager is hereby authorized to execute the Agreement Providing for Exchange of Properties and Quit Claim Deed, copies of which are attached and incorporated herein by reference, providing for the exchange of the city's remaining interest in Lot 7, Block 10, Federal Addition, to Michael J. and Mary Jane Meehan in return for the dedication of the eastern ten feet of Lot 5, Block 4, Oceanview Subdivision Addition No. I, as a public right of way. Section 2. This resolution shall take effect thirty (30) days after passage and posting as required by law.
