Sponsored by: Schaefermever CITY OF SEWARD, ALASKA RESOLUTION NO. 89-080 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, APPROVING THE FY 1990 MUTUAL AID AGREEMENT BETWEEN THE CITY AND THE BEAR CREEK FIRE SERVICE AREA WHEREAS, on February 9, 1987, the City Council approved a Mutual Aid Agreement (the Agreement) between the city and the Bear Creek Fire Service Area; and WHEREAS, the city Fire Department and representatives of the Bear Creek Volunteer Fire Department have tentatively agreed to several amendments to the Agreement and the attached Operations Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The Mutual Aid Agreement and attached FY 1990 Operations Agreement between the city and Bear Creek Fire Service Area, attached and incorporated herein by reference, is hereby approved. Section 2. MUTUAL AID AGREEMENT THIS AGREEMENT, made and entered into this ____ day of , 19___, by and between the CITY OF SEWARD on behalf of the SEWARD FIRE DEPARTMENT and the KENAI PENINSULA BOROUGH on behalf of the BEAR CREEK FIRE SERVICE AREA, to provide for mutual fire protection services as follows: 1. MUTUAL AID REQUESTS The senior fireman on duty for the fire department of any of the participants in this Agreement may solicit the aid of any or all of the other members hereto in the form of men, equipment or materials in order to fight fire where it has spread, and to render such other assistance as may be necessary . in an emergency situation. 2. INFORMATION PROVIDED The requesting agency shall, upon its request, give concise directions as to the location of the emergency, the men, equipment and materials then needed, and make full and complete disclosure as to the then-known circumstances and nature of the emergency. Upon solicitation by the other member fire department, the department solicited may respond with equipment, men or materials as may be necessary during the course of the emergency. 3. LEVEL OF RESPONSE A request for fire department equipment, material and men may be denied in part or in total if the senior fireman on . duty of the requested agency determines, in his absolute City of Seward/BCFSA Mutual Aid Agreement Page 1 of 5 Pages discretion, that it is in the best interests of the area normall~' served by the requested agency to deny such request. Should it be determined by the senior fireman on duty of the requested agency that requested level of aid cannot be rendered, said fireman should immediately notify the requesting agency that the requested level of aid cannot be supplied and at what level, if any, it can be supplied. 4. COMMAND RESPONSIBILITY Upon arrival of the requested agency at the scene of the emergency, all men, materials and equipment shall remain in the command of the requested agency officer in charge (OIC). The requested agency OIC shall report to and operate under the direction of the requesting agency OIC. 5. REQUESTED AGENCY WITHDRAWAL - CIRCUMSTANCES Following response with the requested men, materials, or equipment, should it then be necessary to withdraw a portion or all of such men, materials or equipment in order to meet an emergency situation in the area served by the requested agency, such withdrawal may be at the sole discretion of the senior officer of the requested agency. Such withdrawal may also be made at the sole discretion of the highest ranking officer of the requested agency at the scene if he should determine, in his sole discretion, that the requested agency's men and equipment are being subjected to unnecessary or unreasonable danger. These withdrawals will be coordinated with the requesting agency's Ole. City of Seward/BCFSA Mutual Aid Agreement Page 2 of 5 Pages . 6. LZABILITIBS Each party hereto shall bear its own costs of the response. Each responding agency shall bear its own liability while traveling to the scene, at the scene, and returning to its own quarters. 7. RBSPONSIBILITY/LIABILITY FOR EQUIPMENT NO equipment shall be loaned for use by personnel who have not been trained in its use. Any equipment loaned to either agency, which is in its care, custOdy and control, shall be returned in as good condition as when it was loaned, and any damage occurring while under loan shall be repaired or replaced at the expense of the borrower agency. The cost of replacing any . equipment lost or damaged by the requested agency shall be borne by the requested agency so long as the loss or damage occurred while it was under the control of the requested agency's officer in command. Consumable materials used by the requested agency shall be replaced by the requesting agency. 8. OPERATIONS PLAN Actions taken under this mutual aid agreement shall fOllow guidelines set forth in an annual operations plan. The 1989 operations plan is attached hereto and incorporated herein as "Exhibit A." A review board, consisting of the two highest- ranking officers available from each agency, shall meet annually, prior to the anniversary of this Agreement, to review that year's mutual aid activity and the operational plan. Minutes of this . meeting and any proposed amendments to the operations plan shall City of Seward/BCFSA Mutual Aid Agreement Page 3 of 5 Pages be presented to the governing bodies of each respective agency. If patterne of deficiency are discovered, the deficient agency mus~ agree to correct that deficiency before the anniversary of the subsequent agreement. Any modification or amendment to the operations plan shall be authorized and executed by the Mayor of the Kenai Peninsula Borough and the City Manager of the City of Seward. 9. TBRM OF AGREEMENT This Agreement shall continue from year to year, perpetually, until either party hereto serves thirty (30) days' written notice of intent to withdraw from or change the said agreement, said notice to be mailed via certified mail to the other parties hereto at their last known addresses. This Agreement entered into by and between the above- mentioned parties and on the date and year herein before set out. Reeves, Deputy Borough Attorney Page 5 of 5 Pages EXHIBIT A MUTUAL AID AGREEMENT SFD/BCFSA FY 1990 OPERATIONS PLAN SEWARD FIRE DEPARTMENT and BEAR CREEK FIRE SERVICE AREA This Operations Plan is authorized by the City of Seward, the Board of Directors of the Bear Creek Fire & Emergency Medical Service Area, and the Kenai Peninsula Borough in an agreement dated , 1989. The purpose of this Operations Plan is to outline the procedures for carrying out a Mutual Aid response between the Seward Fire Department and the Bear Creek Fire Service Area. This Operations Plan is a guide for the day-to-day operations of each department for requesting fire and rescue assistance. This Operations Plan may be revised, amended or altered only in conformance with the procedures set out in the Mutual Aid Agreement. 1. RESPONSE AREAS a. Bear Creek Fire Service Area (BCFSA) personnel may prOVide firefighting services as requested by Seward Fire Department (SFD) at the location of a fire emergency to which SFD has been dispatched, located within the City of Seward; except BCFSA shall not respond to a fire emergency at the Spring Creek Correctional Center, but will provide primary fire response throughout the SFD area in the event that all 1990 Operations Plan Exhibit A SFD/BCFSA Page 1 of 5 Pages . SFD resources are utilized for response to a fire b. emergency at the Spring Creek Correction Center. SFD may provide firefighting services as requested by BCFSA at the location of any emergency to which BCFSA has been dispatched, within the boundaries of the Bear Creek Fire Service Area. 2. COMMAND The incident commander in whose jurisdiction the emergency exists, and who places a request for aid, shall in all instances be in command of the emergency response as to the aspects of strategy, fire control tactics and overall direction of the operation. . Upon arrival of the requested agency at the scene of the fire emergency, all men, materials and equipment shall remain in the command of the requested agency officer in charge (OIC). The requested agency OIC shall report to and operate under the direction of the requesting agency OIC. 3. EMERGENCY RESPONSE Neither Department will respond to any emergency in the other department's jurisdiction without an official request for aid from the OIC. 4. COMMUNICATIONS AND CORRESPONDENCE Correspondence regarding day-to-day business or problem resolution will be routed through the Chief or Asst. Chief, or in their absence, designated officer. If the matter cannot be . settled on that level, the matter shall be forwarded to the Service Area Board and the City Manager. 1990 Operations Plan Exhibit A SFD/BCFSA Page 2 of 5 Pages 5. TRAINING A joint training exercise should be carried out at least once a year in each jurisdiction to upgrade operational procedures in firefighting, communications, etc., so that the two departments operate as a single coordinated force rather than two separate agencies. 6. FIRE INCIDENT REPORTING Each agency shall be responsible for reporting the incident in accordance with its own procedures, and shall provide copies of its report to the other agency upon request. 7. WATER SUPPLY SYSTEMS Bear Creek Fire & Emergency Medical Service Area will request permission to use any hydrant within the city limits. When such a request is made, through dispatch, Seward Fire Department's on-duty fire officer will state which hydrant(s) can be used. During an emergency refill of BCFSA tankers, SFD may set up a reservice area to provide for a quick turnaround for BCFSA tankers. Location of the reservice area will be determined by the SFD Officer. The reservice area location may change due to public safety considerations such as traffic congestion, etc. Seward Fire Department will request use of BCFSA tanker(s) through the BCFSA Senior Fire Officer. BCFSA shall supply driver(s) for each unit requested. Each unit shall be refilled with water after completion of the required task. 1990 Operations Plan Exhibit A SFD/BCFSA Page 3 of 5 Pages . 8. CLEANUP RESPONSIBILITY A1l overhaul and salvage following a mutual aid effort shall be conducted by the requesting agency. 9. COST REIMBURSEMENT Any special firefighting chemicals used by the responding department from their own supply, at the request of the requesting department, shall be paid for at cost by the department requesting aid, upon receipt of an itemized statement of costs for such chemicals. 10. EMERGENCY MEDICAL SERVICES Emergency response shall not include the response of medical personnel, equipment and/or basic life support unit . (ambulance) from Bear Creek Fire & Emergency Medical Service Area for the sole purpose of providing emergency medical services within the City of Seward.
