CITY OF SEWARD, ALASKA
RESOLUTION NO. 89-095
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROVING A CONTRACT AMENDMENT
EXTENDING THE BILLING AGREEMENT BETWEEN THE
CITY AND DENALI BROADCASTING
WHEREAS, on November 23,1987, the City Council adopted
Resolution No. 87-111, approving an agreement transferring
equipment, ownership and control of television translator station
K09DL to Denali Broadcasting; and
WHEREAS, the transfer agreement, executed by the parties on
January l3, 1988, provided that the city of Seward would continue
to include on area utility bills a fee for television service which
could be paid voluntarily by utility customers as a contribution
toward the provision of K09DL television service to the community;
and
WHEREAS, it was further agreed that any voluntary contribu-
tions collected by the city as referenced above, less 12.5% paid
to the city for administering collections, would be paid to Denali
Broadcasting; and
WHEREAS, on August 22, 1988, the Council approved Amendment
No. 1 to the Transfer Agreement, extending the billing agreement
between the city and Denali Broadcasting through August 31, 1989;
and
WHEREAS, this amendment provided that the billing agreement
could continue thereafter only upon approval of the city Council
following public hearing; and
WHEREAS, a public hearing as required by Amendment No. 1 was
conducted on August 28, 1989; and
WHEREAS, the Council finds it in the public interest to extend
the Billing Agreement in order to assure continued television
service to the community;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized to execute
Amendment No. 2 to the Transfer Agreement between the city of
Seward and Denali Broadcasting, extending the Billing Agreement
between the parties. A copy of the Amendment is attached and
incorporated herein by reference.

section 2. This resolution shall take effect immediately upon
its adoption.
PASSED AND APPROVED by the City Council of the city of Seward,
Alaska, this 28th day of August, 1989.
