RESOLUTION NO. 96-154
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING PAYMENT TO EBA ENGINEERING FOR
TESTING OF CONCRETE INSTALLED AT WATERFRONT PARK
SKATEBOARD FACILITY AND APPROPRIATING FUNDS
WHEREAS, in July 1996, the City Council approved Resolution No. 96-091, authorizing
construction of a skateboard facility in Waterfront Park for a price not to exceed $30,836.50; and
WHEREAS, the contract for construction of the facility was awarded to Homeland
Enterprises for the amount budgeted by the City Council; and
WHEREAS, testing of the concrete to assure compliance with construction specifications
has caused the project to exceed the authorized project budget; and
WHEREAS, this testing has been completed by EBA Engineering at the request of the City
with all tests verifying that the materials used for the skateboard facility meet or exceed the
specifications; and
WHEREAS, funding for the testing is available in the Fund Balance Account reserved for
community center renovations;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to issue payment in the amount of $360 to EBA
Engineering for testing of concrete installed at the Waterfront Park Skateboard Facility.
Section 2, The sum of $360 is hereby appropriated from the General Fund Fund Balance
Account No, 101-0000-3041 (Reserves for Community Center Reservations) to the Parks
Maintenance Contract Services Account No. 101-1410-5390,
Section 3. This resolution shall take effect immediately upon its adoption,
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 9th day
of December, 1996.

LEASE AMENDMENT NO.1

THE CITY OF SEWARD, ALASKA, a home rule municipal corporation, organized and existing under the laws
of the State of Alaska, hereinafter referred to as "CITY", and POLAR EQUIPMENT, INC. dba COOK INLET
PROCESSING, PO Box 8163, Nikiski, Alaska 99635, hereinafter referred to as "LESSEE", hereby agree that the lease
between them for two (2) parcels, both situated within Alaska Tideland Survey 1222 in that tract of land known as the
Seward Marine Industrial Center, all within Section 18, TIS, RIE, SM, Seward Recording District, Third Judicial District,
State of Alaska; Parcel A of which, located on what is called the CIP Dock, contains 11,700t square feet, and Parcel B of
which, located in the southeast comer of the intersection of what is called Sorrel Road and Morris A venue, contains
13,400t square feet, is hereby amended as follows:
Delete Section 6.2 - Operation ReQuirements to the end of Article 6, Insert the following in its stead:
6.2 - Wharfage Charges
All fresh incoming fish purchased by LESSEE that are transported to the Seward facility
and that meet anyone or more of the following conditions shall be exempt from wharfage
charges as published in the CITY's Port and Harbor Tariff:
a, All fresh fish or shellfish as defined in SCC 9 7.10.135 that are processed at the Seward
facility; or
b, All fresh fish or shellfish that qualify for the allocation of the state raw fish tax to the
City of Seward; or
,
c, All fresh low-value fish product with a per-pound value of less than $0.50, which shall
be subject to a wharfage rate of one percent (1 %) of the gross fish ticket value.
In all other respects, the Lease is to remain unchanged and in full force between the undersigned parties.
IN WITNESS WHEREOF, the parties hereto have executed this document, and it is effective this _ day of
November, 1996,
