Sponsored by: Schaefermeyer CITY OF SEWARD, ALASKA RESOLUTION NO. 91-007 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, APPROVING AN AMENDMENT TO THE TRANSFER OF RESPONSIBILITIES AGREEMENT FOR THE CONSTRUCTION OF THE PRISON INDUSTRIES FACILITY WHEREAS, the original TORA with the state of Alaska for construction of the prison industries and hobby shop was approved in the amount of $203,400: and WHEREAS, work on this project is essentially complete: and WHEREAS, during project design and construction it became apparent that certain final work could be accomplished by the Department of Corrections using staff and prison labor: and WHEREAS, utilizing this approach would reduce cost of construction and provide an occupation for certain prisoners; and WHEREAS, Department of Corrections has requested reimbursement of the cost which would otherwise have been paid from the TORA funds: and WHEREAS, an amendment to the TORA reducing its amount by $36,000 would allow the Department of Transportation and Public Facilities to return these monies to Department of Corrections; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Manager is hereby authorized to execute Amendment No. 2 to the Spring Creek Prison Industry Facility Tora, reducing the amount of the agreement from $203,400 to $167,400, a copy of which is attached and incorporated herein by reference. Section 2. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 14th day of January, 1991. TWO (2) TO THE TRANSFER OF RESPONSIBILITIES AGREEMENT The Transfer of Responsibilities Agreement, effective the 17 th day of August 1989, between the State of Alaska Department of Transportation and Public Facilities and the City of Seward for the purpose of constructing a prison industries addition to Seward Spring Creek Prison, is hereby amended as follows: Amend Section t. Reducing funding by $36,000 from $203,400.00 to $167,400.00. The State agrees to transfer the funds appropriated by the Legislature for the project to a special account in the State Treasury. The transferred to this special account for the Municipality shall not exceed a total of One Hundred Sixty Seven Thousand, Four Hundred dollars ($167,400.00). The State and the Municipality agree that any cost required to be incurred for the completion of this project in excess of the above amount will be paid by the Municipality. All other provisions of the original Agreement, as amended, remain in force.
