RESOLUTION NO. 91-049
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROVING THE ASSIGNMENT OF
BOARDWALK LEASE SITE NO. 5 FROM LEE GORDANIER
TO RANDY J. BECKER
WHEREAS, on May 27, 1987, the city of Seward entered into an
agreement with Michael G. McKern for the lease of Boardwalk Lease
site No. 5 for a period of 10 years; and
WHEREAS, on February 9, 1988, the city agreed to an assignment
of said lease from Mr. McKern to Lee D. Gordanier under the terms
and conditions of the original lease: and
WHEREAS, Mr. Gordanier has sold the lease improvements to
Randy J. Becker, and Mr. Becker wishes to be assigned lease
interest in Boardwalk Lease site No.5: and
WHEREAS, Mr. Becker has proposed to use the site as a charter
boat office, and said use is an allowed use within the Harbor
Commercial Zone:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. Assignment of an Agreement to Lease Seward Small
Boat Harbor Boardwalk Lease Site No. 5 from Lee D. Gordanier to
Randy J. Becker is hereby APPROVED.
section 2. A copy of the Assignment of Lease is attached and
incorporated herein by reference.
section 3. This resolution shall take effect immediately upon
its adoption.
PASSED AND APPROVED by the city Council of the city of Seward,
Alaska, this 28th day of May, 1991.

ASSIGNMENT OF LEASE
THIS AGREEMENT, made and entered into between LEE GORDANIER,
of P.O. Box 267, Seward, Alaska 99664 hereinafter called the
ASSIGNOR and RANDY J. BECKER of P.O. Box 872, Seward, Alaska 99664
hereinafter called the ASSIGNEE;
WHEREAS, by lease dated May 27, 1987, and recorded by Lease
Memorandum June 22, 1987, in book 47, beginning at page 703, Seward
Recording District, Third Judicial District, State of Alaska, made
between the city of Seward and Michael G. McKern, the premises
described as Seward Small Boat Karbor Boardwalk Lease site No.5,
Block , oceanview Subdivision, City of Seward, Alaska, containing
900 square feet more or less, was leased for 10 years from the 27th
day of May, 1987, and subject to the covenants, conditions and
stipulations therein.
WITNESSETH, by Assignment of Lease dated February 9, 1988 and
recorded March 18, 1988 in Book 50 beginning at Page 662, said
lease was assigned from Michael G. McKern to Lee D. Gordanier,
subject to the original lease covenants, conditions and
stipulations.
WITNESSETH, that in consideration for valuable consideration
paid by the Assignee to the Assignor, receipt whereof is hereby
acknowledged, the Assignor assigns to the Assignee the premises
described in said lease for the unexpired term of said lease,
subject to the payment of rents and performances of the covenants,
conditions and stipulations therein.
The Assignee covenants during the continuance of said term to
pay the rents reserved and to perform the covenants, conditions,
and stipulations in said lease to be performed by the Assignor and
to keep indemnified the Assignor against all actions, claims, and
demands whatsoever in respect to the said rents, covenants,
conditions, and stipulations, or anything relating thereto.
IN WITNESS WHEREOF, the parties hereto have set their hands
and seals on the dates indicated.
