HomeMy WebLinkAboutRes1997-035 r r Sponsored by: Garzini CITY OF SEWARD, ALASKA RESOLUTION NO. 97-035 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING AN APPLICATION TO THE ALASKA DEPART- MENT OF NATURAL RESOURCES FOR PATENT TO PUBLICLY-OWNED TIDELANDS WITHIN THE CORPORATE LIMITS OF THE CITY WHEREAS, AS 38.05.825 provides for the conveyance to a municipality of tide and submerged lands that are occupied or suitable for occupation and development if the land is located within the boundaries ofthe municipality; and WHEREAS, since the 1970's, the City of Seward has focused on diversifying the community's economy through the development of an industrial center in the Fourth of July Creek area and development of other waterfront sites including the Alaska SeaLife Center and Waterfront Park; and WHEREAS, the City has previously requested and received a patent to tidelands identified as ATS 174 and ATS 1222 and deeds to various upland parcels through the Alaska Municipal Entitlement Program; and WHEREAS, the City has applied for patent to occupied tidelands within the corporate limits of the City identified as Alaska Tideland Survey 1380 which are currently leased to Seward Forest Products by the Alaska Department of Natural Resources; and WHEREAS, there are approximately 7000 lineal feet of shoreline along the east side of Resurrection Bay which include unsurveyed tidelands with development potential associated with adjacent upland developments; and WHEREAS, the Seward Forest Products sawmill has closed, and the City is actively working with the current owner/lessee and other private parties to transfer uplands ownership for development of a harbor and dock facility; and WHEREAS, consolidated ownership at the municipal level of publicly-owned waterfront uplands along with the tide and submerged lands within the corporate limits of the City has positive benefits in pursuing the planned land use and economic goals ofthe community; and WHEREAS, the City recognizes that the State has no available funding to accomplish the conveyance of State-owned tide and submerged lands except through City reimbursement of its direct costs; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: CITY OF SEWARD, ALASKA RESOLUTION NO. 97-035 Section 1. The City of Seward is eligible to receive patent to Alaska tidelands under AS 38.05.825 because: A. The tidelands are located within the corporate limits of the City of Seward; B. Use of the tidelands would not unreasonably interfere with navigation; C. Adequate public access is provided within the immediate area; D. The tidelands are not subject to any shore fisheries lease under AS 38.05.082; E. The Tidelands are zoned compatible with the adjacent uplands in accordance with an approved municipal land use plan; and F. The land is part of a public-private industrial development. Section 2. The City of Seward hereby submits the attached application, incorporated herein by reference, to the Alaska Department of Natural Resources under AS 38.05.825 for conveyance of the remainder of the currently unsurveyed State-owned tide and submerged lands located along the east side of Resurrection Bay within the corporate limits of the City. Section 3. The City of Seward is prepared to enter into a special services agreement to prioritize the transfer and to reimburse the State of Alaska for the direct costs associated with the transfer of said tidelands from the State to the City. Section 4. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 10th day of March, 1997.
