HomeMy WebLinkAboutRes1997-053 r r Sponsored by: Garzini CITY OF SEWARD, ALASKA RESOLUTION NO. 97-053 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, APPROVING A LONG-TERM LEASE OF PROPERTY LOCATED IN THE SEWARD MARINE INDUSTRIAL CENTER TO PATRICK M. MARRS WHEREAS, Patrick M. Marrs submitted an unsolicited proposal to lease certain city-owned real property located within the Seward Marine Industrial Center; and WHEREAS, the City Council directed the administration to enter into negotiations with Marrs for a long-term lease of the property; and WHEREAS, the parties have agreed to a 20-year lease of a 20,000 square foot parcel at an initial fair market lease rate of $2,000 per year; and WHEREAS, it is in the public interest to lease this property to Marrs for the construction of a warehouse building to house a marine electronics shop; and WHEREAS, in accordance with standard city lease procedures, a public hearing was properly noticed and conducted at the April 28, 1997 regular meeting of the City Council; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Manager is authorized and directed to execute a long-term lease of a 20,000 sq.ft. tract of land located within Block 4, Fourth of July Creek Preliminary Plat KPB No. 93-087 to Patrick M. Marrs under the terms and conditions set forth on "Attachment A" which is incorporated herein by reference. Section 2. This resolution shall take effect thirty (30) days after passage and posting as required by law. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 28th day of April, 1997. '., r r CITY OF SEWARD, ALASKA RESOLUTION NO. 97-053 Lease Site: Survey of Site: Lease Term: Lease Rate: Improvements: ATTACHMENT A The proposed area for the lease is a tract ofland measuring 20,000 square feet (100' x 200'), more or less, as depicted on the SMIC area map attached hereto as Exhibit A. [Article 1, Page 1] The site will be surveyed, at Lessee's expense, within ninety days of the effective date of the lease. In addition, upon completion of planned improvements to the site, Lessee will provide City a copy of an as-built survey depicting the improvements as completed. [Article 1, Page 2; Article 6, Page 10] The term of the lease will commence on the effective date ofthis Resolution and will run for twenty years through May 27, 2017. Further, Lessee will have the right to extend the initial term for two additional five-year periods, cumulative extensions not to exceed ten years. [Article 2, Page 3] The initiallease/rental rate for the leased land will be $2,000.00 per year which represents fair market value. The leasefrental rate will be adjusted to the then-current fair market value on June 30, 2000 and every five years thereafter throughout the lease term. [Article 3, Page 4] Lessee will construct a warehouse building with interior marine electronics shop on the lease site. Construction will be completed by June 30, 1998.
