I r r Sponsored by: Garzini CITY OF SEWARD, ALASKA RESOLUTION NO. 97-074 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, CONSENTING TO THE KENAI PENINSULA BOROUGH PLANNING COMMISSION APPROVAL OF A PETITION TO V ACA TE A PORTION OF THE TWENTY FOOT ALLEY WITHIN BLOCK 8 OF THE ORIGINAL TOWNSITE OF SEWARD WHEREAS, Kim Kowalski, Arlene Wiley and Kim Hasty petitioned the Kenai Peninsula Borough to vacate that portion of the twenty foot alley within Block 8 of the Original Townsite of Seward bounded by Lots 13 through 28, and the southerly 10 feet of Lots 12 and 29; and WHEREAS, the Seward Planning & Zoning Commission held a public hearing on the petition at its May 7, 1997, meeting and recommended City Council consent of the approved vacation contingent upon a number of conditions; and WHEREAS, at its May 12, 1997, meeting, the Kenai Peninsula Borough Planning Commission approved the requested vacation contingent upon the following conditions: 1. The dedication width and depth, be as determined necessary by the City of Seward to provide adequate turning space to protect and meet the delivery and service needs of existing and future businesses. 2. The petitioners/developers will be responsible for costs involved in the relocating of existing utilities. 3. Prior to final platting, easement locations will be worked out with City of Seward Utilities and Cablevision. 4. Submittal of the final plat within one year of vacation approval. 5. The Seward City Council has thirty days in which they may veto Planning Commission approval of the vacation; and WHEREAS, as a result of tests conducted by the Fire Department in coordination with the Electric Department, Public Works and solid waste contractor, the Manager of Engineering and Utilities and the Fire Chief have both recommended a 40 foot alley dedication, as opposed to the proposed 20 foot dedication, to accommodate emergency and public utility service equipment; and WHEREAS, the Seward City Council has thirty (30) days from that decision to veto approval of the vacation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: CITY OF SEWARD, ALASKA RESOLUTION NO. 97-074 Section 1. The City Council hereby consents to the Kenai Peninsula Borough Planning Commission's approval of the petition to vacate that portion of the twenty foot alley within Block 8, Original Townsite of Seward bounded by Lots 12 through 28, all within said Block 8, provided that the new alley dedication be no less than 40 feet wide to accommodate City of Seward service and emergency vehicles. Section 2. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 27 day of May, 1997.
