HomeMy WebLinkAboutRes1997-077 r r Sponsored by: Garzini CITY OF SEWARD, ALASKA RESOLUTION NO. 97-077 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, NOTIFYING THE SEWARD ASSOCIATION FOR THE AD- V ANCEMENT OF MARINE SCIENCE (SAAMS) THAT THE CITY WILL NOT SEEK REIMBURSEMENT OF THE $50,000 THAT WAS APPROPRI- ATED AS A CONTRIBUTION IN 1991 WHEREAS, on October 28, 1991, the City Council approved Resolution No, 91-135, appropriating $50,000 to SAAMS to help cover the cost of the original Alaska SeaLife Center promotional brochure; and WHEREAS, although SAAMS intended to repay the $50,000 if fund raising efforts from private donations were successful, the City Council did not expect repayment, and the appropriation was set up as a contribution rather than a loan; and WHEREAS, SAAMS has been carrying $42,000 on its books as a loan payable to the City and has requested forgiveness of the anticipated repayment of the contribution; and WHEREAS, as part of its lease obligations to the City, SAAMS will collect on all sales and rents an amount equal to the City sales tax, if such sales and rents are not exempt from sales tax, and remit to the City of Seward; and WHEREAS, SAAMS has contributed to the City of Seward and the community in several ways: 1) the City receives one percent in indirect overhead on the grants received from the Alaska State Legislature and the Exxon Valdez Oil Spill Trustee Council; 2) SAAMS paid $265,000 for the Northern Stevedoring and Handling Corporation warehouse in order for the City to reacquire the property; 3) SAAMS contributed $35,000 to relocate the youth center; 4) SAAMS paid the costs in planning, designing, financing, constructing and operating the SeaLife Center including $104,541 in building permit fees and $50,000 towards the cost of retiring the overhead electric lines in front of the SeaLife Center; and 5) SAAMS has offered to donate the fencing around the construction site to the City; and WHEREAS, although it was originally assumed that SAAMS would own and operate the SeaLife Center, an agreement between the City and SAAMS provides for City ownership with a 50- year operating lease by SAAMS for the financing, construction, operation and maintenance of the facility; and CITY OF SEWARD, ALASKA RESOLUTION NO. 97-077 WHEREAS, the City has a vested interest to ensure the success of SAAMS as the City could end up operating the facility for up to two years before the Department of Fish and Game would assume operation if SAAMS is not successful. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The Seward Association for the Advancement of Marine Science is hereby notified that the City of Seward does not intend to seek reimbursement of the $50,000 contribution to SAAMS for promotional brochures that was approved by Resolution No, 91-135 on October 28, 1991. Section 2. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 9th day of June, 1997.
