I r r Sponsored by: Garzini CITY OF SEWARD, ALASKA RESOLUTION NO. 97-098 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AWARDING A CONTRACT TO EXPAND THE RAILWAY AVENUE PAVING PROJECT WITHOUT FULL UTILIZATION OF CITY BID PROCEDURES, APPROVING A FUNDING AGREEMENT WITH SAAMS AND APPROPRIATING FUNDS WHEREAS, certain portions of Railway Avenue are in need of replacement as part of the Alaska SeaLife Center construction, and the remainder of Railway Avenue is in need of repair; and WHEREAS, The SeaLife Center paving contractor, Frontier Paving, will be on-site this week to pave the SeaLife Center parking lots and the section of Railway Avenue removed during the construction; and WHEREAS, it is in the public interest and cost effective to utilize the contractor to pave the remaining sections of Railway A venue that are in need of repair in conjunction with the paving for the Alaska SeaLife Center; and WHEREAS, only one street closure will be required if the paving is completed as one expanded project; and WHEREAS, Frontier Paving has bid the project at a cost of $76,502 plus a contingency of $7,650,20; and WHEREAS, The SeaLife Center will contribute $50,000 toward the expansion project. WHEREAS, the SeaLife Center currently owes the City of Seward $39,342,25 for its portion of the underground utility project and has requested a waiver of the reimbursement to the City because the project is beneficial to the community; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The city manager is hereby authorized to enter into a contract with Frontier Paving for an amount not to exceed $76,502 plus a contingency amount of $7,650,20 for a total amount of $84, 152,20 without full utilization of city bid procedures, Section 2. The amount of $39,342,25 reimbursement to the Electric Enterprise Fund is hereby waived, CITY OF SEWARD, ALASKA RESOLUTION NO. 97-098 Section 3. The sum of $50,000 is hereby appropriated from the Alaska SeaLife Center to the Capital Acquisition Fund Miscellaneous Revenue Railway Paving Account No, 103-0000-4880- 0490-0103A; the sum of not to exceed $34,152.20 is hereby appropriated from the General Fund Fund Balance Account No, 101-0000-3050 to the Capital Acquisition fund operating transfers in Account No.1 03-0000-3070-0000; and the sum of $84, 152.20 is hereby appropriated to the Capital Acquisition Fund Contract Services Account No, 103-1030-5390-0103A. Section 4. The City Council finds that the public interest would be best served by not requiring competitive bids/proposals because it is believed that the paving can be procured at a cost when the contractor and its equipment and personnel are already on site in the City for the adjoining Sea Life Center project. It will be cost effective to utilize the same contractor to complete the paving as an expanded project and only one street closure will be required, This will also avoid unnecessary delays in completing the work during the City's busy summer season, Section 5. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 27 day ofJune, 1997.
