RESOLUTION NO. 97-104
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE A
LONG-TERM LEASE WITH DENNIS AND THERESA BUTTS DBA
QUALITY MARINE OF ALASKA FOR REAL PROPERTY CONSISTING
OF APPROXIMATELY 72,000 SQUARE FEET LOCATED AT LOT 4
BLOCK 7, FOURTH OF JULY CREEK SUBDIVISION, SEWARD MARINE
INDUSTRIAL CENTER (PRELIMINARY PLAT)
WHEREAS, Dennis and Theresa Butts, dba Quality Marine of Alaska requested the lease
of real property at a site adjacent to Morris Avenue at the Seward Marine Industrial Center to operate
their vessel repair business; and
WHEREAS, the site is currently used by the harbor as a lay down area for vessels using the
250 ton travelift; and
WHEREAS, the lease proposal was reviewed by the Planning and Zoning Commission on
June 4,1997; and
WHEREAS, the Planning and Zoning Commission has recommended that the City enter
into a lease agreement with Dennis and Theresa Butts subject to the following stipulations:
a, All property comers must be well marked with posts that are clearly visible all year;
b, The land must be surveyed and the subdivision plat must be amended to create Lot 4
Block 7, Fourth of July Creek Subdivision, Seward Marine Industrial Center;
c, The leased property must be squared up with other adjacent lease sites and/or easements
so as not to leave any odd or potentially unusable land areas; and
d, The lease must clearly state that the prospective lessees will not construct any structures
atop the utility easements,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized to negotiate a long-term lease with Dennis
and Theresa Butts dba Quality Marine of Alaska for approximately 72,000 square feet located at Lot
4 Block 7, Fourth of July Creek Subdivision, Seward Marine Industrial Center (preliminary plat),
Section 2. This resolution shall take effect immediately upon its adoption,
