CITY OF SEWARD, ALASKA
RESOLUTION NO. 97-113
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AN
AGREEMENT BETWEEN THE STATE OF ALASKA, DEPARTMENT OF
FISH AND GAME AND THE CITY OF SEWARD FOR THE PURPOSE OF
ENTERING INTO AN OPERATIONS AGREEMENT FOR THE
MARl CULTURE FACILITY BETWEEN THE CITY OF SEWARD AND
THE QUTEKCAK NATIVE TRIBE
WHEREAS, at the July 14, 1997 City Council Meeting, representatives of Qutekcak Native
Tribe (QNT) Shellfish Hatchery requested that the City assume responsibility as the governmental
agency in order to allow the Alaska Department of Fish and Game (ADF&G) to sole-source the
operation of the shellfish hatchery to QNT rather than advertise requests for proposals; and
WHEREAS, at the July 28, 1997 City Council Meeting, the Council requested the City
Administration to pursue such an arrangement; and
WHEREAS, the project is a state facility that should serve the interests of the entire
mariculture industry, and it is beneficial to keep the operation of the shellfish hatchery in Seward;
and
WHEREAS, the City desires a local operator and firmly supports science, research and the
development ofthe shellfish industry; and
WHEREAS, following a meeting with Robert Clasby, Director of ADF&G's Commercial
Fisheries Management and Development Division, the City received a draft contract for operation
of the facility which states that the City would be responsible and held liable for all aspects of the
operation and maintenance of the facility; and
WHEREAS, the City has limited technical knowledge of the mariculture industry so it
could delegate the operation and maintenance of the facility to QNT through a sublease agreement;
and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized to negotiate a contract with the Alaska
Department ofFish and Game transferring responsibility for the State Shellfish Hatchery to the City

and to accept the contracts between the ADF&G and the University of Alaska and between the
University of Alaska and the City of Seward.
Section 2. The City Manager is hereby authorized to negotiate a single-source operation and
maintenance agreement for the State Shellfish Hatchery with Qutekcak Native Tribe and prepare
written findings of fact that it is in the public interest to award the contract without full utilization
of city bid procedures.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this II day
of August, 1997.
