I r r Sponsored by: Garzini CITY OF SEWARD, ALASKA RESOLUTION NO. 97-135 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO EXECUTE A TWENTY-YEAR LEASE WITH RANDY J. BECKER, FORA PORTION OF BLOCK 6, OCEANVIEW SUBDIVISION, DESCRIBED AS SMALL BOAT HARBOR BOARDWALK LEASE SITE NO.4 WHEREAS, in order to ensure the continued use of valuable city-owned land in the harbor area and to allow for local businesses' long-term planning, the City Council authorized the issuance of a request for proposals for various sites along the boardwalk in the Small Boat Harbor; and WHEREAS, in response to said request for proposals, Randy J. Becker, submitted a proposal to lease one site known as Site No.4, and on November 12, 1996, the Council approved Resolution 96-144 awarding the Exclusive Right to Negotiate lease terms with Randy J. Becker; and WHEREAS, the City of Seward and Randy J. Becker have concluded their negotiation of said lease agreement; and WHEREAS, the lease rate for the subject property has been set at fair market value as determined by recent appraisals in the Small Boat Harbor area; and WHEREAS, the City Council has determined that a lease of the leased land to Randy J. Becker for the purposes described herein would be in the public interest; and WHEREAS, Lease No. 86-056 between the City of Seward and Ron Mager dba Major Marine Tours for Boardwalk Site No.4 will terminate upon the effective date of the lease with Randy J. Becker; and WHEREAS, it is the intent to transfer from the City of Seward to Randy J. Becker the entire burden of compliance with present or future environmental regulations or controls with respect to the Lessee's operations on the lease land during the lease term; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The long-term lease (twenty years with two five-year extension options) of approximately 1,220 square feet of city property preliminarily described as a portion of Block 6, CITY OF SEWARD, ALASKA RESOLUTION NO, 97-135 Oceanview Subdivision, and more commonly known as Boardwalk Site No.4, within the City of Seward, State of Alaska, to Randy J. Becker, for the development and operation of a marine charter/retail business operation, is hereby APPROVED. Section 2. The lease shall become effective upon the effective date of the Resolution and shall expire on September 23, 2017; the rental rate for the leased property shall be assessed at $2.22 per square foot until June 30, 2000, or the next rental adjustment date. Any sublease of the Leased Land must receive the prior written consent of the City, Section 3. The city manager is hereby authorized and instructed to execute the lease agreement on behalf of the City on the date it becomes effective, Section 4. Lease No, 86-056 between the City of Seward and Ron Mager dba Major Marine Tours for Boardwalk Site No, 4 is hereby TERMINATED upon the effective date of this lease. Section 5.
