CITY OF SEWARD, ALASKA
RESOLUTION NO. 97-145
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROVING AMENDMENTS TO THE FY 1998 LEGAL
BUDGET AND APPROPRIATING FUNDS
WHEREAS, the FY 1998 approved budget established the total legal budget for each fund;
and
WHEREAS, legal subject matters that exceed $10,000 require Council approval; and
WHEREAS, the sum of $7,500, which is available in the approved General Fund legal
budget, is recommended for the Historic Railroad Depot Lease legal subject matter; and
WHEREAS, two new legal subject matters have been established due to the filing of a
lawsuit by McDonald and Wakefield regarding I st amendment rights issues and land transfer issues;
and
WHEREAS, the sum of$IO,OOO from the Harbor Enterprise Fund is needed to account for
the costs dealing with the Seward Forest Products lease termination and the sale and lease of the
property at the sawmill site; and
WHEREAS, the sum of $7,500, which is available from the approved Harbor Enterprise
Fund legal budget, is needed for additional legal costs associated with the Gateway Texaco Lease
boundary dispute and subsequent lawsuit;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The FY 1998 legal budget of$7,500 is appropriated from Legal Subject Matter
No, 1001, General Fund, General Government, to Subject Matter No, 1028, Historic Railroad Depot
Lease,
Section 2. The FY 1998 legal budget of$7,500 is hereby appropriated from legal subject
Matter No, 1001, General Fund, General Government to Subject Matter No. 1029, McDonald vs,
City of Seward, 1 st Amendment Rights Issues,
Section 3. The sum of $15,000 is hereby appropriated from the Harbor Enterprise Fund
retained earnings, Account No, 401-0000-3050 to Legal Subject Matter No. 4109, McDonald vs,
City of Seward, Land Transfer Issues, Account No, 401-4370-5170-4109.

Section 4. The sum of $10,000 is hereby appropriated from the Harbor Enterprise Fund Land
Sales, Account No, 401-4370-4640-0200 to Legal Subject Matter No, 4103, Seward Forest
Produces, Account No, 401-4370-5170-4103 in the Harbor Enterprise Fund.
Section 5. The sum of$7,500 is hereby appropriated from Legal Subject Matter No, 4102,
Harbor Fund General Legal, to Legal Subject Matter No, 4108, Gateway Texaco Lease.
Section 6. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 25 day
of August, 1997.
