CITY OF SEWARD, ALASKA
RESOLUTION NO. 97-159
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AMENDING THE LEGAL BUDGET AND APPROPRIATING
FUNDS FROM THE GENERAL FUND AND THE HARBOR ENTERPRISES
FUND TO LEGAL SUBJECT MATTER ACCOUNTS ESTABLISHED FOR
THE MCDONALD/W AKEFIELD LITIGATION
WHEREAS, two legal subject matters were established to account for the McDon-
ald/Wakefield litigation and
WHEREAS, one legal subject matter is First Amendment Rights Issues and the other is
Land Transfer Issues; and
WHEREAS, the legal costs to-date for this lawsuit have exceeded the budgeted amounts;
and
WHEREAS, the City Attorney is estimating an additional cost of $15,000 for the First
Amendment Rights Issues; and
WHEREAS, it is recommended by the Administration to budget an additional $15,000 to
this legal subject matter from the General Fund fund balance; and
WHEREAS, there is also a recommendation by the administration that the Land Transfer
Issues budget be increased by $10,000; and
WHEREAS, it is recommended by the Administration to budget an additional $10,000 to
this legal subject matter from the Harbor Enterprise Fund retained earnings account; and
WHEREAS, there have also been increased legal expenditures related to the Seward Forest
Products lease; and
WHEREAS, the increase in legal costs for the land transfer are also partly due to the delay
caused by the McDonaldIWakefield litigation; and
WHEREAS, it has been difficult to budget the legal costs of the land transfer given the
various complexities of the land transfer; and
WHEREAS, it is anticipated that the sale and lease of property at the sawmill site will cover
the legal costs related to this subject matter; and

WHEREAS, it is recommended by the Administration to budget an additional $10,000 to
this legal subject matter from the Harbor Enterprise Fund Land Sales account; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The sum of$15,000 is hereby appropriated from the General Fund fund balance,
account no. 101-0000-3050 to legal subject matter no. 1029, McDonald vs. COS - First
Amendment Rights Issues, account no. 101-1115-5170-1029; the sum of $10,000 is hereby
appropriated from the Harbor Enterprise Fund retained earnings, account no. 401-0000-3050 to legal
subject matter noA109, McDonald vs COS - Land Transfer Issues, account no. 401-4370-5170-
4109; and the sum of$10,000 is hereby appropriated from the Harbor Fund Enterprise Land Sales,
account no. 401-4370-4640-0200, to legal subject matter no. 43103, Seward Forest Products, Harbor
Enterprise Fund account no. 401-4370-5170-4103.
Section. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council ofthe city of Seward, Alaska, this 13 day
of October, 1997.
