RESOLUTION NO, 97-168
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, CALLING FOR AN INVESTIGATION INTO ALLEGED
CAMPAIGN VIOLATIONS ASSERTED IN THE ELECTION CONTEST
NOTICE PERTAINING TO THE OCTOBER 7,1997 MUNICIPAL ELEC-
TION
WHEREAS, on October 3, 1997 a mailer was sent out to box holders alleging that Mayor
Louis Bencardino and former City Clerk Linda Murphy broke election laws in 1996; and
WHEREAS, there was a determination by the Division of Election Director, Sandra Stout,
stating that Mayor Louis Bencardino and Linda Murphy had not violated election laws; and
WHEREAS, on October 13, 1997 the City of Seward received a proposed contest notice
related to the City's general election held on October 7, 1997; and
WHEREAS, this contest notice called for the City Council to investigate asserted corrupt
election practices; and
WHEREAS, the City Council views these charges as serious and deserving of investigation;
and
WHEREAS, the City Council desires an investigation into the alleged wrongful conduct
pertaining to the campaign flyer, and any other corrupt election practices; and
WHEREAS, the City Council requests the assistance from the Alaska State Troopers with
this investigation;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City of Seward hereby requests that the Alaska State Troopers investigate
the matters raised in the proposed election contest pertaining to the October 7, 1997 City of Seward
election.
Section 2. The City of Seward hereby requests that the findings of this investigation be
forwarded to the Alaska Division of Elections, Alaska Public Offices Commission, and the Alaska
District Attorney.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council ofthe City of Seward, Alaska, this 23 day
of October, 1997.
