Orr CITY OF SEWARD, ALASKA RESOLUTION NO. 97-186 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, SUPPORTING CHANGES TO HOW THE ALASKA DEPARTMENT OF REVENUE INTERPRETS THE ALASKA CORPORA- TION NET INCOME TAX STATUTE AS IT APPLIES TO OWNERS OF FOREIGN-FLAGGED SHIPS AND AIRCRAFT OPERATING IN ALASKA WHEREAS, it has been brought to our attention that the Legislature will soon be asked to review the Corporation Net Income Tax and its impact on foreign-flagged vessels and aircraft; and WHEREAS, this legislation, as enacted, was challenged and overturned by the court; however, the Alaska Department of Revenue has appealed the lower court ruling to the Alaska Supreme Court; and WHEREAS, we feel that this is a bad tax for three reasons: it will deter future private sector investment; it will be paid largely by Alaskans, not foreign corporations; and it is anticipated that the tax would be arbitrary and capricious by not being applied equally to all corporations; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The Seward City Council supports the lower court decision and hopes that the Supreme Court upholds this decision. Section 2. The Seward City Council does not support an interpretation of the tax code which will deter future private sector investment; will be paid largely by Alaskans, not foreign corporations; and is anticipated that the tax would be arbitrary and capricious by not being applied equally to all corporations. Section 2. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 24 day of November, 1997.
