CITY OF SEWARD, ALASKA
ORDINANCE NO. 98-08
AN ORDINANCE AMENDING SEWARD CITY CODE, CHAPTER 4.05, TO
AUTHORIZE THE USE OF BALLOT COUNTING SYSTEMS APPROVED
FOR USE IN STATE ELECTIONS
WHEREAS, the Alaska Division of Elections has recently purchased hardware and software
for a new ballot counting system for use in state elections; and
WHEREAS, the legislation appropriating funding for this new system authorized the Director
of the Division of Elections to establish rules, regulations and procedures for the counting of ballots
cast in state elections; and
WHEREAS, the Kenai Peninsula Borough Assembly has appropriated funds in the FY 1999
budget to purchase software and hardware that will allow the borough to utilize the same ballot
counting system as that purchased by the state; and
WHEREAS, currently, the City of Seward Elections Code authorizes manual counting of
paper ballots and computer counting of punch card ballots, but is silent as to other forms of ballot
counting; and
WHEREAS, it is in the public interest for the city's election procedures to conform, to the
extent possible, to those employed by the State and the Borough; and
WHEREAS, authorizing the use of election systems approved for use in state and borough
elections will allow, but not dictate, conformity when such conformity is in the best interest of the
City and city voters;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SEW ARD, ALASKA, that:
Section 1. Seward City Code Chapter 4.05 is amended by adding a new section to read
as follows:
4.05.150 Other ballot counting systems authorized.
Nothing in this title prohibits the use of other ballot counting systems which have been
approved for use in State of Alaska or Kenai Peninsula Borough elections. The Election
Supervisor, subject to any further approval as may be required by law, may prescribe rules
for the use of these systems or may adopt such rules, regulations and procedures as have been

adopted by the State for use in State elections, or by the Kenai Peninsula Borough for use in
Borough elections.
Section 2. This ordinance shall take effect following pre-clearance by the U. S. Department
of Justice.
