CITY OF SEWARD, ALASKA
RESOLUTION NO. 98-004
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AMENDING THE FISCAL YEAR 1998
LEGAL BUDGET & APPROPRIATING FUNDS
WHEREAS, several Fiscal Year 1998 budget adjustments to legal subject matters are
needed to cover the cost of increased legal activity in these particular areas; and
WHEREAS, a budget of $80,000 was approved for the General Fund legal expenditures for
FY 98 based on actual legal activity for FY 97; and
WHEREAS, due to increased legal costs on several subject matters, it is recommended that
legal subject matter No. 1001, General Fund General Government be increased by $25,000; and
WHEREAS, the Historic Railroad Depot Lease was originally budgeted at $7,500, and a
budget amendment is needed to close out this subject matter; and
WHEREAS, the legal costs for the McDonald vs. City of Seward, Land Transfer Issues,
budgeted from the Harbor Enterprise Fund, have exceeded the current budget of $25,000; and an
increase is needed due to ongoing litigation; and
WHEREAS, legal costs for the Shellfish Hatchery subject matter have exceeded the $10,000
budget, and an increase is needed to finalize the operating agreements; and
WHEREAS, under an agreement with Qutekcak Native Tribe, the City will be reimbursed
for QNT's legal costs associated with this transaction; and
WHEREAS, a budget increase is recommended for the Seward Forest Products legal subject
matter due to the complexities associated with the land transfer and the delay caused by the
McDonald/Wakefield lawsuit; and
WHEREAS, the City anticipates recovering the legal costs of the Seward Forest Products
legal subject matter from the sale and lease of the sawmill property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The sum 0[$25,000 is hereby appropriated from the General Fund fund balance,
Account No. 101-0000-3050 to Legal Subject Matter No. 1001, General Fund General Government,
Account No.1 01-1115-5170-1 001.
Section 2. The sum of $5,000 is hereby appropriated from various General Fund Legal
Subject Matters:

Section 3. The sum of $12,000 is hereby appropriated from the Harbor Enterprise Fund
Retained Earnings, Account No. 401-0000-3050 to Legal Subject Matter No. 4109, McDonald vs.
City of Seward, Land Transfer Issues, Account No. 401-4370-5170-4109.
Section 4. The sum of $19,000 is hereby appropriated from the General Fund Legal
Recoveries, Account No. 101-1115-5172 to Legal Subject Matter No. 1030, QNT/Seward
Mariculture Agreement, Account No. 101-1115-5170-1030.
Section 5. The sum of$5,000 is hereby appropriated from the Harbor Enterprise Fund Land
Sales, Account No. 401-4370-4640-0200 to Legal Subject Matter No. 4103, Seward Forest Products,
Account No. 401-4370-5170-4103 in the Harbor Enterprise Fund.
Section 6. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 12th
day of January, 1998.
