CITY OF SEWARD, ALASKA
RESOLUTION NO. 98-014
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, ACCEPTING OWNERSHIP OF STATE LANDS IDENTIFIED AS
TRACT B, ALASKA RAILROAD RIGHT OF WAY (ADL 201288) FROM
THE DEPARTMENT OF NATURAL RESOURCES UNDER THE MUNICI-
PAL LANDS ENTITLEMENT ACT
WHEREAS, the Alaska Municipal Land Entitlement Act of 1978 provides for the selection
and transfer of up to 565 acres of state lands to the City of Seward; and
WHEREAS, to date, the City has utilized 542.219 acres of its entitlement; and
WHEREAS, Resolution No. 97-036 authorized the City to apply to fulfill a portion of its
remaining municipal entitlement balance with land located within the city's Waterfront Park and
identified as Tract B ofthe Alaska Railroad Right of Way; and
WHEREAS, the Alaska Department of Natural Resources has posted a Public Notice of a
Preliminary Finding and Decision to transfer said lands to the city; and
WHEREAS, a public hearing was conducted on March 9,1998 regarding the acquisition of
Tract B of the Alaska Railroad Right of Way as part of the city's entitlement under the Alaska
Municipal Land Entitlement Act of 1978;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. Upon issuance of a patent from the Alaska Department of Natural Resources the
City of Seward will accept ownership of that parcel of land identified as Tract B of the Alaska
Railroad Right of Way (ADL 201288) as part of its entitlement pursuant to Alaska Statutes
29.65.020.
Section 2. This resolution shall take effect thirty (30) days after its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 9th day
of March, 1998.
