CITY OF SEWARD, ALASKA
ORDINANCE NO. 99-01
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AMENDING TITLE 9, HEALTH AND SAFETY BY DELETING
ALL REFERENCES TO KENNELS IN CHAPTER 9.05 ANIMALS AND
FOWL; AND AMENDING TITLE 15, PLANNING AND LAND USE
REGULATIONS, REGARDING ANIMAL SHELTERS AND KENNELS
WHEREAS, Ordinance No. 92-14 amended the Seward Zoning Code to define a kennel as
any enclosure, building, shelter, area, or establishment used for the purpose of breeding, buying,
selling, keeping, or boarding four or more dogs over the age of four months, whether for profit,
pleasure, or as pets, by any person, individual, corporation, group of people or business entities; and
WHEREAS, the ordinance also amended the Zoning Code, Land Uses Allowed Table to
prohibit a kennel within the City; and
WHEREAS, Chapter 9.05 Animals and Fowl defines a kennel as any lot, building, structure,
enclosure or premises whereon or wherein four or more dogs may be kept, and states that kennels
require an annual license, pending compliance with zoning and animal welfare criteria; and
WHEREAS, since the adoption of Ordinance No. 92-14, there has been a conflict between
the Zoning Code and Chapter 9.05 Animals and Fowl; and
WHEREAS, in order to correct this conflict with the Zoning Code, Chapter 9.05 Animals
and Fowl needs to be amended to delete all references to a dog kennel; and
WHEREAS, on January 6, 1999 the Planning and Zoning Commission held a public hearing
on the proposed ordinance, and recommended City Council approval of the ordinance.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OFSEW ARD,ALASKA
HEREBY ORDAINS that:
Section 1. SCC ~ 9.05.110, Definitions, is hereby amended by deleting the definition of
"Kennel" .
Section 2. SCC ~ 9.05.210, Licenses required, is hereby amended to read as follows
No owner or harborer of any dog over four months of age shall fail or neglect or refuse to
obtain a license for such dog.

Section 3. SCC ~ 9.05.214, License fee--kennels, is hereby amended by deleting the entire
section.
Section 4. SCC ~ 9.05.216, License fees--collection; issuance and form of license tag.
Subsection A., the first sentence is hereby amended to read as follows:
A. The license collector shall, and it is hereby made his duty to, see that the licenses from
every owner or harborer of dogs required to be licensed are paid.
Section 5. SCC ~ 9.05.256, Limitation of number of animals permitted to be kept, is
hereby amended by deleting the entire section.
Section 6. SCC ~ 15.10.140, Definitions, is hereby amended as follows:
Animal shelter. Any facility operated by a humane society, or governmental agency or its
authorized agents, for the purpose of impounding animals under the authority oflocal or state law
for care, confinement, return to owner, adoption, or euthanasia.
Kennel. Any enclosure, building, shelter, area, or establishment used for the purpose of
breeding, buying, selling, keeping or boarding five or more dogs over the age offour months, whether
for profit, pleasure, or as pets, by any person, individual, corporation, group of people or business
entity. Does not include an animal shelter.
Section 7. SCC Table 15.10.225, Land Uses Allowed, is hereby amended to allow an
Animal shelter as an outright use in the Industrial District.
Section 8. This ordinance shall take effect ten (10) days following its enactment.
