CITY OF SEWARD, ALASKA
RESOLUTION NO. 98-032
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO AN
AGREEMENT WITH ROZAK ENGINEERING WITHOUT THE FULL
UTILIZATION OF CITY BID PROCEDURES TO PROVIDE SERVICES
NECESSARY TO ALLOW REMOVAL OF UNDERGROUND FUEL TANKS
FOR AN AMOUNT NOT TO EXCEED $16,000, AND FURTHER
AUTHORIZING THE PURCHASE OF NEW FUEL TANKS AND OTHER
MATERIAL FOR AN AMOUNT NOT TO EXCEED $3,400
WHEREAS, Federal and State Law requires the City of Seward to replace underground fuel
storage tanks which are used for stand-by generators by December 31, 1998; and
WHEREAS, the City of Seward has received an estimated cost from Rozak Engineering to
provide the necessary technical support to allow the City of Seward's crews to do the actual work;
and
WHEREAS, Rozak Engineering's estimated costs, plus the cost of the new tanks and a
$2,500 contingency for possible contamination is $19,400; and
WHEREAS, Rozak Engineering comes highly recommended to the City of Seward by other
users of its service; and
WHEREAS, the removal of fuel tanks is a "Professional Service"; and
WHEREAS, professional services are exempt from the competitive bidding process under
Seward City Code 6.10. 120(A)(8); and
WHEREAS, to competitively bid this contract would only add additional cost and delay to
the project;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Council approves Resolution 98-032, authorizing the City Manager to
enter into an agreement with Rozak Engineering to provide services necessary to allow removal of
underground fuel tanks for an amount not to exceed $16,000, and further authorizing the purchase
of new fuel tanks and other materials for an amount not to exceed $3,400.
Section 2. Funding for this project shall be paid from the Water and Sewer Retained
Earnings Account Number 701-0000-3050.

Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 13th
day of April, 1998.
