CITY OF SEWARD, ALASKA
RESOLUTION NO. 98-036
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROPRIATING FUNDS FROM THE HARBOR ENTERPRISE
FUND LAND SALE ACCOUNT TO THE SEWARD FOREST PRODUCTS
ACCOUNT TO COMPLETE THE LAND TRANSFER EXCLUDING THE
TRANSFER OF CERTAIN TIDELANDS
WHEREAS, the legal subject matter regarding the Seward Forest Products lease termination
and the sale and lease of the property at the sawmill site has incurred approximately $52,735 in legal
expenses through FY 1997; and
WHEREAS, an additional $15,000 was appropriated to this legal subject matter in FY 1998;
and
WHEREAS, due to the complexities of the land transfer and the delay caused by the
McDonald/Wakefield lawsuit, it has been difficult to budget actual legal costs for this subject matter;
and
WHEREAS, the legal costs through February 20 have exceeded the $25,000 budget; and
WHEREAS, it is recommended that an additional $6,000 be appropriated to complete the
land transfer with the exception of the tidelands and an additional $5,000 be appropriated to
complete the second closing related to the tideland lease; and
WHEREAS, the City has received approximately $366 in recovered legal costs for the
McDonald/Wakefield lawsuit, $25,921 from the insurance proceeds for legal costs for the Jones vs.
City of Seward lawsuit, $567 from the sale of tax foreclosed properties and $17,381 from Qutekcak
Native Tribe for reimbursement oflegal fees related to the Seward Mariculture Facility Agreements;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The total of $11 ,000 is hereby appropriated from monies from the sale of the
sawmill site.
Section 2. The sum of$11 ,000 is hereby appropriated from the Harbor Enterprise Fund Land
Sales, Account No. 401-4370-4640-0200 to Legal Subject Matter No. 4103, Seward Forest Products,
Account No. 401-4370-5170-4103.

Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 13 day
of April, 1998.
