Sponsored by: Gifford CITY OF SEWARD, ALASKA RESOLUTION NO. 98-040 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, APPROVING A USE AGREEMENT WITH COOK INLET AQUACULTURE ASSOCIATION FOR USE OF A PORTION OF BLOCK 10, FOURTH OF JULY CREEK SUBDIVISION, SEWARD MARINE INDUS- TRIAL CENTER FOR A SALMON RELEASE AND HARVEST SITE WHEREAS, Cook Inlet Aquaculture Association (CIAA) wishes to establish a viable commercial sockeye stocking and harvesting program in the Seward area to sustain its financial abilities to carry out aquaculture projects throughout the Cook Inlet, Kenai Peninsula and Resurrection Bay areas; and WHEREAS, CIAA desires to establish a fish stocking site in the Seward area to provide community residents and visitors with additional recreational fishing opportunities funded through the Seward Chamber of Commerce Fish Restoration Fund; and WHEREAS, CIAA has identified Spring Creek, within the Seward Marine Industrial Center, as an ideal location because of its clear spring-fed water, stable flow, ease of access and proximity to salt water; and WHEREAS, the City has received a letter from the Alaska Department ofFish and Game (ADF&G) stating that the CIAA project will not make the current designation of Spring Creek more restrictive, nor adversely affect the City's ability to obtain ADF&G permitting for future development in the Seward Marine Industrial Center; and WHEREAS, the city has received a letter of non-objection to the project from the owners ofthe private land adjacent to and north of Spring Creek; and WHEREAS, the City recognizes the value ofCIAA's efforts to enhance commercial and sportfishing as a part of the local economy and desires to cooperate with ClAA to provide access to and space in and along Spring Creek to accommodate a proposed fish stocking and harvesting site. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Manager is authorized to sign the Use Agreement, attached and incorporated herewith by reference, between Cook Inlet Aquaculture Association and the City of Seward for the use of a portion of Spring Creek and Block 10 Fourth of July Creek Subdivision Seward Marine Industrial Center, for salmon release and harvest. Section 2. This resolution shall take effect immediately upon its adoption.
