RESOLUTION NO. 98-041
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY OF SEWARD TO ACCEPT A
PATENT TO ~ 160 ACRES OF TIDE AND SUBMERGED LANDS ON THE
EAST SHORE OF RESURRECTION BAY BETWEEN ATS 174 AND ATS
1380, INCLUDING UNAPPROVED ATS 920 AND BETWEEN ATS 1380 AND
ATS 1222 (ADL 227191) FROM THE ALASKA DEPARTMENT OF
NATURAL RESOURCES
WHEREAS, Alaska Statutes 38.05.820 and 825 provide for the conveyance to a
municipality of tide and submerged lands that are occupied or suitable for occupation and
development ifthe land is located within the boundaries ofthe municipality; and
WHEREAS, through Resolution 97-035, the City applied to the State of Alaska for
conveyance of those state owned tide and submerged lands located within the corporate limits of the
city and known as Alaska Tideland Survey 1380; and
WHEREAS, the Alaska Department of Natural Resources has posted a Public Notice of a
Decision to Convey Tide and Submerged Lands to the City of Seward; and
WHEREAS, in accordance with Seward City Code Chapter 7.05, a public hearing was
conducted on April 27, 1998, regarding the acquisition of unsurveyed Alaska state tide and
submerged lands on the east shore of Resurrection Bay between ATS 174 and ATS 1380, including
unapproved ATS 920 and between ATS 1380 and ATS 1222 (ADL 227191) under the term of
Alaska Statutes 38.05.820.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. Upon issuance of a patent from the Alaska Department of Natural Resources the
City of Seward will accept ownership of that parcel of yet-to-be-surveyed Alaska state tide and
submerged lands on the east shore of Resurrection Bay between ATS 174 and ATS 1380, including
unapproved ATS 920 and between ATS 1380 and ATS 1222 (ADL 227191) pursuant to Alaska
Statute 38.05.820.
Section 2. This resolution shall take effect thirty (30) days after its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 27th
day of April, 1998.
