HomeMy WebLinkAboutRes1998-043 I I I Sponsored by: Gifford CITY OF SEWARD, ALASKA RESOLUTION NO. 98-043 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE ADMINISTRATION TO PROCEED WITH NEGOTIATIONS TO LEASE A 500 SQUARE FOOT PORTION OF LOT 13, BLOCK 16, OTS, TO PENINSULA COMMUNICATIONS, INC. (PCI), FOR A SATELLITE DISH, ALLOW PCI TO USE SPACE AND POWER IN THE EQUIPMENT SHELTER LOCATED ON LOT 9, BLOCK 16, OTS, AND PLACE TWO ANTENNAS ON THE CITY OWNED TOWER ON LOT 9, BLOCK 16, OTS, SUBJECT TO THE PLANNING & ZONING COMMIS- SION'S RECOMMENDED CONDITIONS WHEREAS, K-WAVE FM 105 and KPEN FM 102 radio have served the Seward area continuously for the past five years; and WHEREAS, Peninsula Communications, Inc. (PCI), the licensee ofK-W AVE and KPEN, entered into a five year lease with Alascom for space and power which is now up for renewal; and WHEREAS, PCI has not been able to negotiate a lease renewal with the new owners of the Marine Terminal, Pacific Telecom Cable, Inc., and is seeking another site from which to broadcast the low power FM translator signals; and WHEREAS, Dave Becker, President of PC I, has submitted a request for the City of Seward to either lease or enter into a use agreement with PCI and its assign, Coastal Broadcast Communications, Inc., to: 1) provide 500 square feet of City-owned Lot 13, Block 16, Original Townsite of Seward, located north of City Hall, for a satellite receiver dish; and 2) provide space and power for FM translators to be located in the City-owned equipment shelter; and 3) place two antennas on the City-owned tower; and WHEREAS, as directed by the City of Seward Lease Policies and Procedures, the Planning and Zoning Commission reviewed the request at its April 1, 1998, meeting and recommended that the City Council approve the request subject to the following conditions: CITY OF SEWARD, ALASKA RESOLUTION NO. 98-043 1. If at any time in the future the City needs the property for any other use, the city will have the right to terminate the lease, and the lessee will be responsible for finding a new location and relocating the equipment at its own expense; and 2. The lessee must provide assurances that the addition of the proposed equipment will not cause interference with any other radio frequencies or signals, and the lessee will be responsible for correcting any interference problems generated by the equipment. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Council hereby approves Resolution No. 98-043, directing the administration to proceed with negotiations to lease a 500-square-foot portion of Lot 13, Block 16, OTS, to PCI for a satellite dish, allow PCI to use space and power in the equipment shelter located on Lot 9, Block 16, OTS, and place two antennas on the City-owned tower on Lot 9, Block 16, OTS, subject to the Planning & Zoning Commission's recommended conditions. Section 2. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 27th day of April, 1998.
