CITY OF SEWARD, ALASKA
RESOLUTION NO. 98-045
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROPRIATING $12,000 FROM THE HARBOR ENTERPRISE
FUND RETAINED EARNINGS ACCOUNT, AND $12,000 FROM THE
GENERAL FUND FUND BALANCE TO LEGAL SUBJECT MATTER NO.
4108, GATEWAY TEXACO LEASE, IN THE HARBOR ENTERPRISE FUND
FOR LEGAL FEES
WHEREAS, a budget of$7,500 was originally approved by the Council for legal subject
matter 4l08, Gateway Texaco lease, for fiscal year 1998; and
WHEREAS, the Council has appropriated $7,500 in the fiscal year 1998 legal budget for
this legal subject matter; and
WHEREAS, this legal subject matter accounts for the costs of the lawsuit Pruitt. et al. v.
City of Seward, dealing with a boundary dispute in the Gateway Texaco Lease; and
WHEREAS, approximately $9,410 oflegal expenditures were incurred through fiscal year
1997 related to the Gateway Texaco lease; and
WHEREAS, based on the estimated legal activity and expert witnesses needed through
June 30, 1998, the Administration is recommending that this legal subject matter be increased by
$24,000 for a total budget of$31,500; and
WHEREAS, the Administration recommends that 50% of the funding for this lawsuit come
from the Harbor Enterprise Fund and 50% from the General Fund in accordance with the budget split
of lease revenues in the Harbor Enterprise Fund;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Council hereby approves Resolution No. 98-045, appropriating $12,000
from the Harbor Enterprise Fund Retained Earnings, Account 401-0000-3050 and $12,000 from the
General Fund fund balance, Account 101-0000-3070-0401 to legal subject matter 4108, Gateway
Texaco Lease, Account 401-4370-5170-4108 in the Harbor Enterprise Fund.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 27th
day of April, 1998.
