RESOLUTION NO. 98-053
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROPRIATING $15,000 FROM THE GENERAL FUND FUND
BALANCE, TO LEGAL SUBJECT MATTER, GENERAL GOVERNMENT,
IN THE GENERAL FUND AND APPROPRIATING $5,000 FROM GEN-
ERAL FUND LEGAL RECOVERIES, TO LEGAL SUBJECT MATTER,
HISTORIC RR DEPOT LEASE, IN THE GENERAL FUND
WHEREAS, it is difficult to foresee the legal activity for any given budget year; and
WHEREAS, the FY 98 budget was very tight, and with the close-out of the hospital and the
debt of the Harbor Enterprise Fund, the General Fund had few discretionary funds available for
unforeseen budget issues; and
WHEREAS, legal subject matter 1001, General Fund, General Government, is at 103.2%
ofthe FY 98 budget through April 20, 1998; and
WHEREAS, the City Attorney is recommending that legal subject matter 1001, General
Fund, General Government be increased by $15,000 from $71,500 to $86,500 in order to get the city
through FY 98; and
WHEREAS, the Administration recommends that funding for this matter come from the
General Fund fund balance; and
WHEREAS, the FY 98 legal budget for subject matter 1028 was approved at $12,500 and
is at 101.8% of budget through April 20, 1998; and
WHEREAS, this legal subject matter had been closed when the lease was completed last
fall; and
WHEREAS, Chugach Alaska Corporation (CAe) has requested that this matter be reopened
to accelerate the time period to purchase the Historic Railroad Depot (depot); and
WHEREAS, CAC has agreed to reimburse the City for any legal fees related to accelerating
the time period to purchase the depot; and
WHEREAS, the City Attorney has recommended that this budget item be increased by
$5,000 to $17,500 for the remainder ofFY 98; and

WHEREAS, funding for this legal subject matter would come from reimbursement of legal
fees from CAC;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Council hereby approves Resolution No. 98-053, appropriating $15,000
from the General Fund fund balance, Account 101-0000-3070-0401 to legal subject matter 1001,
General Government, Account 101-1115-5170-1001 in the General Fund and appropriating $5,000
from General Fund Legal Recoveries, account 101-1115-5172-1028 to legal subject matter 1028,
Historic RR Depot Lease, account 101-1115-5170-1028 in the General Fund.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this lIth
day of May, 1998.
