HomeMy WebLinkAboutRes2005-012 Sponsored by: Applicant CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2005-12 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA, GRANTING A CONDITIONAL USE PERMIT TO THE CITY OF SEWARD FOR ASPHALT PLANT AND GRAVEL OPERATIONS AT TRACT C FOURTH OF JULY CREEK TRACTS, COMMONLY KNOWN AS THE "CITY QUARRY" WHEREAS, the City of Seward Public Works Department has applied for a Conditional Use Permit from the Seward Planning and Zoning Commission for asphalt plant and gravel operations at the quarry at Tract C Fourth of July Creek Tracts; and WHEREAS, the quarry is located in the Industrial Zoning District; and WHEREAS, according to the Seward City Code, Land Uses Allowed Table 15.10.225, "bulk material, i.e., concrete, gravel, sand, asphalt" is allowed in the Industrial Zoning District as a conditionally permitted use; and WHEREAS, the asphalt will benefit public roads and private properties in the community; and; WHEREAS, having complied with the public notification process, on May 4, 2005, the Seward Planning and Zoning Commission held the required public hearing on the Conditional Use Permit application and held additional public hearings on May 17, 2005 and June 7, 2005. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. According to SCC 15.1O.320.D, the Commission shall establish a finding that the use satisfies the following conditions prior to granting a conditional use permit: A. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and the purposes of the zoning district Finding: This condition has been established at the time of agenda distribution. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions shall be met by the applicant. These may include but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. Based on the above findings and conclusions, approval of the CUP shall be subject to the following conditions: 1. A traffic control plan shall be required, which shall include the days and hours of operation along the haul route. The plan will be subject to staff approval. 2. Fuel storage shall only be allowed for onsite asphalt plant operations and storage tanks shall have impermeable catchment entrapments. 3. Adequate sanitation facilities, such as portable latrines, shall be onsite and removed during periods of non-operation. 4. Issuance of this permit does not alleviate the applicant's responsibility to obtain all local, state and federal permits, if required. 5. This permit must be renewed within two years of issuance. The asphalt plant operations may be subject to review by the Planning Commission if unforeseen adverse impacts are unable to be mitigated by staff. 6. The asphalt plant shall have security personnel available. 7. This permit shall require submission and approval of a storm water management plan. 8. The review of the fire safety plan by the fire department shall take into account the uniqueness of the operation and structure. 9. The City shall use reasonable means to locate the asphalt plant outside the area identified as having been affected by flooding with the past twenty years. 10. Modification of final approval of a conditional use permit may, upon application by the permittee, be modified by the Planning and Zoning Commission: a. When changed conditions cause the conditional use to no longer conform to the standards for its approval. b.
