HomeMy WebLinkAboutOrd1999-004 I I I Sponsored by: Janke Introduction Date: April 26, 1999 Public Hearing Date: Mav 10, 1999 Enactment Date: Mav 10,1999 CITY OF SEWARD, AK ORDINANCE NO. 99-04 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, ADOPTING THE 1997 UNIFORM BUILDING CODE AND THE 1997 UNIFORM MECHANICAL CODE, WITH CERTAIN EXCEPTIONS. WHEREAS, various national uniform code updates have been adopted by the State of Alaska; and WHEREAS, it is in the public interest for the City to follow suit in adopting these Codes with certain exceptions to comply with exceptions noted by the State and to meet local needs; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEW ARD, ALASKA HEREBY ORDAINS that: Section 1. Seward City Code Section 12.05.010 is hereby amended to read as follows: 12.05.010 Uniform Building Code adopted. A. The Uniform Building Code, 1997 edition, as on file with the city clerk, published by the International Conference of Building Officials, is hereby designated and shall be known as the Seward building code and shall constitute the laws of the city relating to building regulation. Although not published in full in this section, all of the provisions of the Uniform Building Code, except as provided in Subsection D. below, shall be and are hereby adopted by reference to the same extent as if set forth in full in this section, except to the extent that the Uniform Building Code shall be in conflict with this code or any relevant ordinance later adopted, in which case the provisions of this code shall prevail. B. The city clerk is directed to keep on file at least three copies of the Uniform Building Code, 1997 edition, for public use, inspection and examination, so long as the provisions thereto remain in force. C. It shall be unlawful for any person to erect, construct, enlarge, alter, repair, move, remove, improve, convert, demolish, or equip any building or structure in the city, or cause or permit the same to be done, contrary to or in violation of any of the provisions of the Uniform Building Code adopted and incorporated as the Seward building code by this section. Section 2. A new Section 12.05.010D is hereby enacted to read as follows: D. The Uniform Building Code, 1997 edition, adopted in Subsection A. CITY OF SEWARD, ALASKA ORDINANCE NO. 99-04 above, is hereby amended by adopting the following exceptions to the code: 1. Section 105, Board of Appeals, is deleted; 2. Section 302.5, Exception 1, is revised to read: "1. In Groups A, B, F, I, M, and S Occupancies, boilers, central heating plant or hot-water supply boilers where the largest piece of fuel equipment does not exceed 400,000 Btu per hour (117.2 kW) input."; 3. Section 305.1, Division 3, is revised to read: "Division 3. Any building, or portion of a building, used for day care purposes for more then 6 persons, including children under the age of 12 related to the staff."; 4. Section 305.2.3 is revised by adding a new second paragraph to read: "Group E, Division 3 Occupancies that operate between the hours of! 0 p.m. and 6 a.m. shall be equipped with approved automatic sprinkler system throughout, designed and installed in accordance with N.F.P.A. Standard 13D-1994 or approved equivalent system." ; 5. Section 305.2.3 is revised by adding a new third paragraph to read: "Rooms used for sleeping or napping purposes within an E-3 Occupancy must be provided with a smoke detector that complies with section 310.9.1."; 6. Section 305.2.3, Exceptions, is revised by adding the following paragraphs to read: "4.0 Family child care homes operating between the hours of6 a.m. and 10 p.m. may accommodate a total of eight children without conforming to all the requirements of this regulation except for smoke detectors as specified in Subsection 310.9; exiting, including operable windows in napping or sleeping rooms as specified in Subsection 310.4; and fire extinguisher requirements." "5.0 Day care facilities that are operated in a primary residence between the hours of 6 a.m. and 10 p.m. accommodating up to a total of 12 children may use the second story of the building without complying with Section 305.2.3, Exception 2, Table 5-1, and the type V-I hour requirements set out in table 5-B provided all other code provisions for E- 3 occupancy are met."; 7. Section 508 is revised by adding a new paragraph to read: "EXCEPTION: In one-story E-l Occupancies, a fire sprinkler may be used in accordance with this section for fire-resistive substitution under the following conditions: a. The fire sprinkler system must be fully compliant with U.B.C. standard 9-1; b. The total square footage ofthe building must be 20,000 square feet or less, or area separation walls or occupancy separations having a fire-resistive rating of not less than two hours must be provided to subdivide the building into separate compartments that contain an aggregate floor area not greater than 20,000 square feet. When two-hour rated occupancy separations are used, they must extend up I I I CITY OF SEWARD, ALASKA ORDINANCE NO. 99-04 through the attic to provide a complete fire break."; 8. Section 904.2.4.1 is revised by the deletion of exceptions 1 and 2; 9. Section 1003.3.3.6 is revised by the addition of the following paragraph: "In stairways serving a Group E, Division 3 Occupancy, additional handrails located midway, plus or minus two inches, between the normal handrails and the nosing of the treads must be provided if the stairway serves as an exit for children five years of age or younger. The additional handrail must have a space of not less then 1-1/2 inches between the wall and the handrails. The hand grip portion of the additional handrails must be 1-1/4 inches in cross-sectional dimension."; 10. Section 3004 is amended by deletion of the last sentence in the first paragraph 1 and the addition of a new paragraph between the first and second existing paragraphs to read: "EXCEPTIONS: When energy conservation requires that the vents be normally closed, automatic venting by actuation of an elevator lobby detector or power failure may be accepted. When hoistway pressurization is used, venting upon power failure may be accepted. In either case a manual override must be provided."; 11. Appendix Chapter 15 is revised by deleting Section 1515, calling for inspection of a roof prior to re-roofing; 12. Appendix Chapter 34, Section 3406.1 and 3413 respectively, are revised by adding a second paragraph to read: "The provisions ofthis division may not be construed to allow the elimination of fire protection systems or a reduction in the level of fire safety provided in buildings constructed in conformance with previously adopted codes."; 13. Appendix Chapter 34, Division I, Section 3406.2 is revised to read: "3406.2 Fire Hazard. An existing building, regardless of occupancy, that exceeds the areas or heights allowed by Chapter 5 of this code or that does not conform to the requirements of Section 503, Location on Property, and, in the building official's opinion, presents a serious fire threat to adjacent property, will, in the building official's discretion, be required to have installed an approved automatic sprinkler system, area separation walls, a combination of both, or other approved means intended to reduce the fire threat."; 14. Appendix Chapter 34, Section 3417, Appeal Board, is deleted; 15. Standard 9-1, Section 4-4.1.7 is revised by the addition of a new section to read: "4-4.1. 7.2(a) Elevator Hoistways and machine Rooms. Sidewall spray sprinklers must be installed at the bottom of each elevator hoistway, not more than 2 feet (0.61 m) above the floor of the pit: EXCEPTION: For enclosed, noncombustible elevator shafts that do not contain combustible hydraulic fluids, the sprinklers at the bottom of the shaft are not CITY OF SEWARD, ALASKA ORDINANCE NO. 99-04 required. Automatic sprinklers in elevator machine rooms or at the top of hoistways must be of ordinary temperature rating. Upright or pendent spray sprinklers must be installed at the top of elevator hoistways. EXCEPTION: Sprinklers are not required at the tops of noncombustible hoistways of passenger elevators whose car enclosure materials meet the requirements of ASME A17.1 Safety Code for Elevators and Escalators.". Section 3. Seward City Code Section 12.05.030, Uniform Mechanical Code adopted, is hereby amended to read as follows: 12.05.030 Uniform Mechanical Code adopted. A. The Uniform Mechanical Code, 1997 edition, as on file with the city clerk, published by the International Conference of Building Officials and the International Association of Plumbing and Mechanical Officials, is hereby designated and shall be known as the Seward mechanical code and shall constitute the laws of the city relating to the installation and maintenance of heating, ventilation, cooling and refrigeration systems. Although not published in full in this section, all ofthe provisions ofthe Uniform Mechanical Code, except as provided in Subsection D. below, shall be and are hereby adopted by reference to the same extent as if set forth in full in this section, except to the extent that the Uniform Mechanical Code shall be in conflict with this code or any relevant ordinance later adopted, in which case the provisions of this code shall prevail. B. The city clerk is directed to keep on file at least three copies of the Uniform Mechanical Code, 1997 edition, for public use, inspection and examination, so long as the provisions thereof remain in force. Section 4. A new Section 12.05.030D is hereby enacted to read as follows: D. The Uniform Mechanical Code, 1997 edition, adopted in Subsection A. above, is hereby amended by adopting by following exceptions to the code: 1. Chapter 5 is revised by adding the following to read: "Section 510 General. The provisions of this section apply to installation of kitchen ventilation heat recovery equipment installed within the interior of the building: a. Ceiling Penetrations. Any grease duct or hood penetrating a ceiling, regardless of whether the ceiling is rated, is considered concealed and must be I I I CITY OF SEWARD, ALASKA ORDINANCE NO. 99-04 enclosed within a rated duct enclosure constructed in accordance with Section 507.6; b. Equipment Installations. Only fans associated with heat-recovery devices serving Type I hoods may be located in the grease duct within a rated enclosure. This equipment must be specifically listed for kitchen ventilation application, or the equipment housing must maintain the integrity of the externally welded and liquid-tight duct to the entrance of, and the exit from, the exhaust fan or heat-recovery element. Provisions must be made for access to the equipment and internal components of devices containing fans or heat-recovery elements for proper maintenance and cleaning. Duct-access doors must comply with Section 507.5. Access doors to enclosures must comply with Section 507.7; c. Duct and Equipment Enclosure. A grease duct enclosure may be enlarged to enclose equipment or may connect to the equipment housing if the equipment housing meets the rating of the grease duct enclosure. The duct may be run exposed within the rated equipment enclosure to the entrance of, and the exit from, the equipment that complies with this paragraph of Section 510; d. Fire Dampers. Other associated ductwork located within a grease duct enclosure constructed as described in paragraph 3 of Section 510 must have a fire damper where penetrations of the enclosure occur; and e. Exhaust Outlets. The grease duct shall terminate above the roof in accordance with Sections 507.6 and 507.11. A grease duct enclosure that stops at the rated equipment enclosure must be vented to the exterior as if the rated equipment enclosure were a continuation of the duct enclosure" ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 10 day of May, 1999.
